the $150 is already deducted from the $1200 price.. i could only get it down to $1053 with monitor, $913 without.. so i guess the extra $140 is worth the price for the 19" monitor..

...but then again we got our 5 Dell 17" LCDs and 5 pair HK-695 speakers delivered last Wednesday so Dell does mess up and ship somtimes. Our systems were eventually cancelled on Thursday on the ship date , but then again we were not charged for the LCDs and speakers so we could care less. I have already cancelled the AMEX private payments number used for the order since they did not bother to authorize amount on the CC before shipping. WhooHooooo

HeHe...Perhaps a few minutes learning what credit card fraud is before you go accusing or perhaps when you get old enough to actually own a credit card that might help too. We are a law firm and placed a legitimate order with Dell that they subsequently cancelled after the allowed 72 hour revocation time period under US contract law. This after sending us a confirmation that stated they had verified the order for accuracy and placed or order in productiion. Unlike the rash of recent pricing errors in their addons division when no followup confirmation was sent, we issued a legitimate PO with our credit card order and received a confirmation that stated that they had reviewed our order for accuracy and have placed the order under our PO. This is a binding contract even in the case of a pricing error in all states all but Arizona. It is not or fault or fraud that Dell is too stupid to hire compentent employees that do their job correctly. We contacted AMEX last Thursday after Dell called us on the phone cancelling or order and cancelled the private payments number that was used for the order. AMEX infomed us that we were well within our legal rights to keep merchandise shipped to us and not billed since they did not previously authorize the charges for the order as required under their merchant agreement. We already knew this anyway without AMEX's concent. Just becasue Dell is stuid does not constitute fraud on our part. This is done by freight companies that ship FOB everyday and is not illegal, immoral maybe, but who here has the right to make that judgement as those crying fowl are the worst offenders of all. You are just jealous!

True. Not matter what the promo, system costs tend to average out about the same week after week. Occasionally, they'll slip up and a real deal will slip in there (usually on a low-end system), but once they find out, they immediately exclude it. It's the coupon codes that put a dent in prices.

Unfortunately, it's an attitude like this that has resulted in a lot of the ills that this country is plagued with right now. To use the law to screw someone over is not the true purpose of the law. But, sadly, it is what it has deteriorated into today. This guy knew exactly what he was doing, and his intent was to screw Dell. And since when is being stupid justification for taking advantage of someone. What an awful attitude. Thank goodness for the federal legislation that has discouraged the ambulance chasers from filing tons of law suites over 9/11, which would not really be for the benefit of the victims, but to line their own pockets. Maybe that's why lawyers rank right up there with used car salesman as to the public's perception of them. After all, with an attitude like that displayed above, coupled with the other lawyers we've recently had to deal with, like the Clintons, Nixon, and on and on, what do you expect. I expect to be flamed away, but go ahead. After 28 years serving the good old US of A in the Armed Services, having been shot at and shot back, seeing my friends die to protect the freedom so many Americans abuse, there're nothing you light weights can throw my way which will bother me.

The original used to be a tongue in cheek comment we would make in the military when we were talking about someone with a bad attitude, with the jest of it being, that when it came down to it, it was the lessor of two evils, i.e., any kind of attitude was better than none. Dealing with someone with no attitude was just about impossible, whereas we could deal with a bad attitude. Oh well, I like God Bless America better anyway.

However under the UCC you have a simultaneous acceptance and breach when they shipped a non-conforming order. You know that you are liable for the reasonable value of the shipped merchandise less any provable damages you can prove for the breach.

You are not entitled to the merchandise as liquidated damages.

By the way just where do you practice, perhaps your local committee on ethics would be interested.
