Thanks. Just got off the phone with Troy's legal reps to let them know after next week my legal counsel will be scheduling a deposition with them. My counsel has taken to litigating this on contingency as long as I pay for the filing fees. Which amount to a few hundred bucks right now. He did mention that up until the actual court date that Dick's will have every opportunity to mediate.

When you update, be sure to post the running total of money out of pocket, even if it's a loan to the law firm.

Well today was the deadline and nothing since that letter my attorney got. So I'll be in next week talking with him for the next steps. I already contacted Troy to ask about setting up a deposition through the video conference. Which would be cheaper than my attorney flying out there for it.

Update. Finally made it in to speak with my attorney today. I am paying for the filing fee's and the rest he is doing on contingency. He will be filing next week. Dick's has 20 days to respond to the filing. He said they'll probably counter file a general denial to our filing in the court and serving them. Once filed we will be putting in a subpoena for business communications between Dick's and Troy. As well as taking depositions from each company. After 20 days for filing time, there will be a 50 day discovery time frame before a court date can take place. The court date will be requested once Dick's has filed their counter to our litigation and denial to the court. My lawyer says right now the waiting period is a bit long. He says he just went into court this week for a another small case like mine and the date was 9 months out from when he requested it.

So more waiting I suppose. Litigation takes a long ass time. But the process for it has been filed. Dick's has a chance up until the court date to actual mediate and settle. So resolution may come sooner.

Fourth, at about the same time, Troy Industries informed us that they stopped manufacturing the Troy AR-15 due to a shortage in a component part, the bolt. According to Troy Industries, in order to purchase the bolt to complete the manufacturing of the Troy AR-15 to the outstanding special orders, Troy Industries needed a decision from us to our future plans related to modern sporting rifles. In light of very recent decision to suspend the of modern sporting rifles, and the uncertain regulatory environment, Dick's was not prepared to determine if or when its suspension would end and therefore could not provide any assurances to Troy industries. 0n December 21, 2012, Troy Industries informed Dick’s that it was unable to complete the manufacturing of the Troy AR-15's and fulfill our customers’ special orders.

This certainly sounds like Dick's is trying to shift responsibility onto Troy. You may have to name both in your suit.

So I get to keep the original refund check, my original asking damages from the letter, and all attorney fees paid. So I will get back my retainers as well. Not sure when it will all be finalized, but it doesn't look like it will going to a court room at least. Victory for the little guy consumer this time.

Right now typing this while waiting for ironman to start.

They did not turn over an item he purchased that they had in his possession for political reasons. That is against the law, you can't do that.

On the contrary, taking him to court meant they had everything to lose should things not go their way. It would have cost them a lot more to litigate, and even more should they fail in their litigation (in more than just damages).

I'm still on the fence about the whole thing. But I've come around to it, and HumblePie gets the benefit of the doubt here given the circumstances of his "purchase".

They did not turn over an item he purchased that they had in his possession for political reasons. That is against the law, you can't do that.

Unless you work for Dick's Sporting Goods, you do not know what their reasons were. They refunded his money to him as well so nothing they did was against the law.

No...people of sound mind (of which the OP doesn't seem to be in possession of), would have taken their FULL refund they received from Dick's and went somewhere else.
