No...people of sound mind (of which the OP doesn't seem to be in possession of), would have taken their FULL refund they received from Dick's and went somewhere else.

And that was exactly the OP's point - this was an exclusive carried by Dicks, sold Exclusively by Dicks, manufactured exclusively for Dicks. The OP couldn't go anywhere else, and the store refused to fulfill a transaction that has already had been committed to contractually.

He got his money back to go somewhere else and purchase if he wanted. By the way...he never took possession of the item so, until then, the contract between seller and buyer was never completed. The seller can, at any time, refund the purchaser's money. The mentally disturbed OP who acted like a petulant child didn't win anything. If anything, Dick's decision in the end (which was one based on a financial decision, not admission of breaking of any laws) just reinforced OP's actions so that he'll keep acting this way. But that's the point. Go WHERE ELSE? As I said, and the OP described in great detail already, this was an exclusive item intentionally withheld without reasonable cause by the vendor. There does have to be a line where stored can't just arbitrarily decide to enforce a "moral" code on its customers, especially after they have already initiated a transaction in good faith. That is what the OP is trying to do here.

My lawyer just called and told me that Dick's is finally wanting to settle to my original demand letter. So I get to keep the original refund check, my original asking damages from the letter, and all attorney fees paid. So I will get back my retainers as well. Not sure when it will all be finalized, but it doesn't look like it will going to a court room at least. Victory for the little guy consumer this time.

Who cares what the item was that I purchased. It could have been a kayak order they decided not fulfill out of sympathy of a random canoeing shooting that occurred. Who cares about the details of the item. The problem is they took my money in promise to fulfill an order. Once money has exchanged hands, a legal contract is accepted by both parties. Barring something massively out of their control for being unable to fulfill the order they are legally bound by law to do so.

As for the haters in this thread, I'm not worried about a bunch of idiot internet "badasses" that have no clue how the real world works. Dick's broke a few consumer protection laws for my state. They thought they could get away with it. I stood up for my rights and held them accountable for their actions. I won. Simple as that.

I just realized you are from Texas. This makes a whole lot more sense now. As much as you say this about holding a retail chain responsible for not holding up its end of the bargain, I think it more has to do with a cowboy being pissed off because he didn't get a great deal on an assault rifle. Here in Canada, people get as pissed off as you all the time when a store sells out of back bacon and maple syrup.
