And that was exactly the OP's point - this was an exclusive carried by Dicks, sold Exclusively by Dicks, manufactured exclusively for Dicks. The OP couldn't go anywhere else, and the store refused to fulfill a transaction that has already had been committed to contractually.

So tell me, what else is someone in a similar situation to do? Take it up the ass?

The seller can, at any time, refund the purchaser's money. The mentally disturbed OP who acted like a petulant child didn't win anything. If anything, Dick's decision in the end (which was one based on a financial decision, not admission of breaking of any laws) just reinforced OP's actions so that he'll keep acting this way. Social psychopath ftw!

But that's the point. Go WHERE ELSE? As I said, and the OP described in great detail already, this was an exclusive item intentionally withheld without reasonable cause by the vendor. There does have to be a line where stored can't just arbitrarily decide to enforce a "moral" code on its customers, especially after they have already initiated a transaction in good faith. That is what the OP is trying to do here.

Right or wrong, it doesn't matter anymore. Dicks wins because this gets swept under the rug.

Finally an update to make.

My lawyer just called and told me that Dick's is finally wanting to settle to my original demand letter. So I get to keep the original refund check, my original asking damages from the letter, and all attorney fees paid. So I will get back my retainers as well. Not sure when it will all be finalized, but it doesn't look like it will going to a court room at least. Victory for the little guy consumer this time.

Right now typing this while waiting for ironman to start.

Just got back from watching ironman 3, great movie again imho.

As for the haters in this thread, I'm not worried about a bunch of idiot internet "badasses" that have no clue how the real world works. Dick's broke a few consumer protection laws for my state. They thought they could get away with it. I stood up for my rights and held them accountable for their actions. I won. Simple as that.

Who cares what the item was that I purchased. It could have been a kayak order they decided not fulfill out of sympathy of a random canoeing shooting that occurred. Who cares about the details of the item. The problem is they took my money in promise to fulfill an order. Once money has exchanged hands, a legal contract is accepted by both parties. Barring something massively out of their control for being unable to fulfill the order they are legally bound by law to do so.

I just realized you are from Texas. This makes a whole lot more sense now. As much as you say this about holding a retail chain responsible for not holding up its end of the bargain, I think it more has to do with a cowboy being pissed off because he didn't get a great deal on an assault rifle. Here in Canada, people get as pissed off as you all the time when a store sells out of back bacon and maple syrup.

Congrats, dude. I hope a bunch of people who bought the Troy rifle did the same.

I mailed my cut-up Dick's reward card back to corporate with a short, polite note that I would no longer be dealing with them because of this fiasco.

Also, an AR-15 is not an assault rifle, no matter what demagogues may tell you. You need to go through 6-12 months of paperwork, background checks, fingerprints, headaches, anal probes, etc. in order to own those. Whereas Mr. Bloods or Mr. Crips can just go buy one off the black market...

And for all the people saying he should be happy with his $100 gift card: I challenge you to find the exact product he prepaid for in stock ANYWHERE - you won't.

And to build one similar to it, he'd need knowledge+tools or a gunsmith, and at least $1600 in today's market. I think his settlement is entirely appropriate, and Dick's is appropriately punished for breach of contract.

For all the talk some posters here make complaining the little guy always gets screwed, shouldn't you be happy the little guy won a small victory for once?

Bullshit, it's quite clear Dicks broke state laws. They were clearly legally in the wrong here. You can't just not deliver what you contracted to deliver and had the ability to deliver the goods. Have you ever read purchase order or sales agreement?
