WAAAAY back when, Pepsi had a promotion called pepsi points. top prize was a fighter plane. a 18 year old kid managed to collect the millions of points to win it, but pepsi backed out and the kid sued.

so did he get it?

Whoah man, that judge did a horrible job. If a company makes threats against so and so in an ad, should the reader not be scared simply because they 'know' the company is joking? Especially if it's got all the right gore in it.

Exactly. As a reasonable person, I may not expect a harrier jet, but I expect something of equivalent value. That judge is wrong as wrong can be. Doesn't give me much faith in the justice system.

Oh wow, then the story I've been hearing for years is wrong. I had heard that they gave him the jet on the conditions that he couldn't put gas or armaments on it. I've been telling that to people since I heard it. Boy do I feel stupid

Good. As a reasonable person you shouldn't have any faith in our nation's justice system. It's flawed beyond belief.

Well obviously the investors thought the guy could claim the prize from Pepsi... Just think... all they needed was $700,000 to "buy" the Harrier, which they can probably turn around and sell it for millions to some middle east country...

It's a damn good investment if u ask me (assuming they thought they could get the jet from Pepsi)...

Pepsi never stopped him from purchasing other items. In all honesty, the judge did the correct thing. Nowhere in their catalogs did they list a jet or even a car. To add insult to injury, the judge should have made an order for the kid of only tshirts in xsmall (or some other size that didn't fit him). Besides, how do you talk that many people into giving you that much money for a jet that he couldn't afford to fly or maintain?

Hey...so why don't we remove all humor from our TV ads while we're at it? Seriously though... nomatter how you look at it... nobody could possibly believe that Pepsi would actually give that away. That kid knew it all along. What he did was stupid...beyond imagination. The judge made the right ruling.

I'm surprised it made it that far.

Basic Contract law stipulates that the test for the validity of an offer is whether a reasonable person would believe the offer to be a sincere one. I'm sure that Pepsi's offer was made in jest, and enough so that no ordinary person would believe it to be a legitimate offer.

People seem to have some great misconceptions about the law - the law isn't so stupid as to fault people for whimsical promises, or jestful talk - its not like on TV folks, where technicalities get people rich, and get bad people off all the time.
