Yeah seems bad to say it but he knew he could get away with it since it was just a verbal casual remark, and no way to prove that he said it. That's often how this stuff works.
You'd be surprised. HR knows what resumes he gets and who he brings in to interview. If he thew out a bunch of ethnic/female sounding names and went for nothing but "John Whiteguy" types and you brought it up it could lead to something. Of course that is also a bit risky, for more than one reason. It's a bad situation to be in.
