Lesbian Accuses Doctor's Office Of Giving Her Anti-Gay Literature

UPDATED: 7:16 am EST February 3, 2006

ORLANDO, Fla. -- A 36-year-old lesbian has filed a state complaint against a doctor and physician's assistant alleging she was given literature condemning homosexuality as "sinful and sexually impure" after a routine appointment.

Jamie Beiler, formerly of Kissimmee, saw physician's assistant Dawn Pope-Wright on March 11, 2005, for a bronchitis checkup because her normal doctor was on vacation, according to a Jan. 27 complaint filed with the Division of Medical Quality Assurance. Beiler's sexuality was noted in her medical file, but unmentioned during the appointment, her lawyers said.

When she opened up an envelope Pope-Wright left at the checkout counter, she was shocked to find photocopied pages including Bible verses that denounced homosexuality and asserted God can help her change.

"The information that Ms. Pope-Wright gave to Ms. Beiler was derogatory and offensive, and completely disrespected her right to dignity and privacy," the complaint says.

Also named in the complaint is Dr. John R. Hartman, who allegedly deflected Beiler's concerns when she complained to the office.

Two telephone messages left at Hartman's office, one with an office manager, during business hours were not immediately returned. An office employee said Pope-Wright no longer worked there, and she couldn't be otherwise reached by The Associated Press.

Lawyers Karen Doering and Shelbi Day, who co-authored the complaint on Beiler's behalf, also filed a similar one with her insurer, Cigna HealthCare. The health care company also did not immediately comment.

Doering, senior counsel for the National Center for Lesbian Rights, said Pope-Wright was inappropriately using her job to distribute religious and political beliefs.

"It was just a routine follow-up visit," she said. "It had absolutely nothing to do with her sexual orientation."

This IMHO is total BS, the physician's assistant should have their license revoked...

Anybody think this type of proselytizing should be allowed?

Right, because if anyone ever does ANYTHING that ever offends you, you have a right to shut them down.

I think what this woman did was ridiculous, but if this lesbian was offended she should have gone to a different doctor's office.

Thats really something. Kind of weird that a doctor visit would all of a sudden turn into a discussion of sexual orientation.

"Hi, I'm here for my check up."
"Homosexuality is wrong mmkay?"

The problem here is likely that the Patient didn't read the info given her. If she had the Pixie Dust would have her change her ways and think of her Dr as her best friend.

I disagree, time to shut this down before it even starts. Pharmasists refusing to fill birth control now moral lecturing from doctors. Switching doctors just allows this doc to preach to the next person she disagrees with.

According to the article it sounds like she got material on the way OUT.... after the appointment?

When she opened up an envelope Pope-Wright left at the checkout counter, she was shocked to find photocopied pages including Bible verses that denounced homosexuality and asserted God can help her change.

She isn't paying them for a lecture, I'm sure she gets many of them for free.

So? If it's so tragic, then the doctor will put himself out of business. The problem would work itself out naturally. I'd like to know what about this act could possibly be construed as illegal. Anyone?

It's amazing how hyper sensitive people are now a days. Say or do something they perceive as offensive or an insult and suddenly they want you shut down, what your said or did banned or, as we have seen with the Mohammed Cartoons, killed.

Should the doctor have done what she did? Common sense says no. But these over reactions are getting rediculous. She could just as easily have thrown the damn thing in the trash. But, no. The poor baby was feeling offended. Geez...

IMO, distasteful but not unlawful (that I know of). They are a business and the best way to hurt them is to tell them to piss off and find a new doctor. The office rendered service, so there were no denials of service. Tell them to fvck off and go on. Of course, this makes a statement and gets 15 minutes of fame but will likely not change anything.

This is not church and state we are talking about here, IMO.

If the PA did nothing wrong then why did she get canned?

We don't know the whole story. We don't even know what the literature said? There may be more to it then the story indicates. For instance, why was a complaint filed against Cigna?

Did I miss something but where did it say that she was fired? She no longer working there doesn't mean fired. Anyone?

Yep, it is an assumption on my part. I don't know for a fact that she was asked to leave, only that "she no longer works there" and that AP couldn't seem to find her for her side of the story.

I agree that it wasn't unlawful. The business (if it's entirely privately owned) has a right to distribute anything it wants to anyone it wants.

HOWEVER, I fully believe the individual should launch a campaign designed to bankrupt that business. Picket, distribute flyers, go to the media...make it IMPOSSIBLE for the doctor to earn a living. Just do it all legally with the individuals right to protest.

I don't think the legal system needs to be involved at all, both sides can exercise their rights freely and end up with the correct outcome: the removal of those people from business.
