Fair enough, but that's a pretty big IF.

It's a far bigger stretch to presuppose the PA just "happened" to notice the woman was homosexual and then "happened" to slip some literature to her.

According to what I've read, the sole reference to the patient's sexuality was IN THE CHART. Unless there's a new coding system that uses rainbow charts or stickers of Melissa Ethridge, it seems reasonable to believe the PA read the chart, saw a notation, and decided to make a weak intervention.

Jamie Beiler, formerly of Kissimmee, saw physician's assistant Dawn Pope-Wright on March 11, 2005, for a bronchitis checkup because her normal doctor was on vacation, according to a Jan. 27 complaint filed with the Division of Medical Quality Assurance. Beiler's sexuality was noted in her medical file, but unmentioned during the appointment, her lawyers said.
Even if the patient was heterosexual and had chlamydia trachomatis or syphilis in her respiratory tract or a male homosexual with the same condition, this PA still would have FAILED her medical responsibility to provide appropriate care . . . if all the patient got was photocopied pages of crap . . . not even informative crap . . . but just plain crap.

Even in the hyper-tolerant little confines of UNC-Chapel Hill, the obviously lesbian professionals don't advertise. An MD will note sexual orientation sometimes for no reason other than avoiding the awkward . . . so how's the husband? But a good physician knows those details even without the unshaven legs, Birks, close cropped coif, and preternatural inclination to pantsuits . . . that's a JOKE!

It's amazing what secretaries in smaller practices know about local patients without ever consulting a chart. That said, it's going to be up to the PA to show it. The case now boils down whether this is a violation of HIPPA. Hopefully we will be able to follow this as it unfolds.
