Does my company owe me "back-pay"?!?!

so today i just found out that i had gotten a raise on my most recent paycheck. hooray for me.

it has also come to my attention that the company gave out annual raises every June.

i have a new district manager that took over sometime last year around christmas and for the previous 3 years we had a different district manager. in those previous 3 years the district manager NEVER issued annual June raises!!!
we believe he decided to do this to save "himself" money (SCR, some kind of cost ratio) in the district.

so i have had the same rate of pay since 2008... does my company OWE me that 25cents per every hour i have worked for the past three years?!?!

I don't see why you would. You didn't get a raise and you were willing to continue working for your current wage. Just because because most people got raises, doesn't mean you are entitled to one too.

True, but if other employees got raises, and she didn't.......discrimination, possibly. Especially if the company has a written review policy that wasn't followed.

Unless her contract specified that raises would be given, the company doesn't owe her anything.

A job that does not provide raises for 3 years should've been a red flag in your head, though (and if it was a temporary thing due to the bad economy, there should have been discussions as to when raises would re-commence).

no one in our district, which consists of about 11 studios with about 2 or 3 associates per studio, received raises for the 3 consecutive years. NO ONE.

i received a review every single year with above average, if not stellar, results from my manager.

our new district manager told my manager that "we give raises every June" (perhaps based on performance can your district manager deny you a raise). i distinctly remember our old DM claiming that our commission program was taking place of yearly raises which was clearly a lie based on what the new DM told my current manager! so he LIED to us to keep from issuing raises that were deserved and earned.

They are only deserved and earned if you ask for them. Assuming raises are automatic on good reviews is silly.

i received 2 raises in the first year i worked for this company. i was informed and under the impression that yearly raises were awarded based on performance (which i received excellent performance reviews yearly). we also had a commission program in place based on the sales we made. the commission program was changing semi-frequently and i recall the DM saying that the "new program" would take place of yearly raises. this was a lie. a lie he told so he could deny all 20+ associates yearly raises, regardless of stellar performance. not cool

Hmmm...sounds like everyone got "shafted". Maybe the company had to curtail raises due to the economy? Just remember, raises aren't a sure thing or even required.

i find the economy excuse to be off-base seeing as we were all made fully aware of what the company, our region, district, and individual studios grossed and profited the previous year and were all very on top of current goals and sales. we exceeded sales from each previous year and continue to do so.

Can't hurt to ask HR why every other department got raises annually and you got stiffed. Doubt they'll give you back pay, but they might throw you a couple year's worth of wooden nickels onto your current pay rise, which should at least help going forward.

But really, 3 years and no one in the dept bitched?
