Well, greed is greed, usually wins over things like, really taking a step to help save this country that only a trial would have done. Let's see if there are any terms made public, probably not financial, but if Fox has to admit to anything.

I guess Dominion does not care if it stays in business or not. They just want the big payday. Fair enough, that is quite a few years worth of profit for them, and even winning the suit would not guarantee that they could overcome the stigma Fox created around their brand. I was just hoping that they were looking long term, but I should have known better. What board of directors ever votes for long term sustainability when they can grab a handful of cash today?

It is sort of telling that when asked about apologies, both sides declined to comment. I hope, there is more to come though.

Not surprised at all. Fox is squealing with delight, claiming this proves they are “committed to the highest standards of journalism” blah blah. I doubt they’ll even have to dedicate any on air time to “mea culpas” but we’ll see.

My opinion—this should open the floodgates of JSixers suing Fox for civil liabilities—loss of livelihood post conviction, emotional damages, etc.

“We are pleased to have reached a settlement of our dispute with Dominion Voting Systems. We acknowledge the Court’s rulings finding certain claims about Dominion to be false," Fox said in a statement. “This settlement reflects FOX’s continued commitment to the highest journalistic standards. We are hopeful that our decision to resolve this dispute with Dominion amicably, instead of the acrimony of a divisive trial, allows the country to move forward from these issues.”

What a crock.

So punitive damages were included in the settlement then?
Not explicitly, but the settlement resolves all claims - including removing any risk of punitive damages. So in a sense, the negotiated amount might theoretically include some risk-weighted allowance on punitive damages, but at the end of the day, it is just a single $ figure to resolve all claims.

Yea; pretty darn lame - but what do you expect? One thing that is odd about this settlement is that for the most part it is public; normally the terms are nda and you can't comment on them. To a degree I can understand dominion not wanting to go to trial - not so much the initial trial but then the years long slog of appeals and risk of getting a right wing jury/judge that sweeps the whole thing away during the appeal process. I do wish fox was forced to fully admit (on every news cast for the next 10 years) it made fraudulent statements around the 2020 election.

Kind of, but not really. A settlement does not do things like punitive damages, it is more or less a payoff to drop the suit. There will be no official judgement, and Fox will pay Dominion and do whatever they agreed to in the settlement make the case go away. It looks like in this case it required Fox to make a statement that they got 'some facts wrong' in their story.
In a few weeks they will be spinning it that they just made minor errors in names and places and that it what this was all about.

Greed won again and again democracy will suffer. I can only hope that someday businesses will be treated like a privilege and not a right and we will get back to businesses needing to be a benefit to the public.
