you can plead the 5th in a civil case, but the jury is allowed to make a negative inference based upon that, unlike a criminal case.

this is the issue with Trump Org in NY State - it's a civil case, and while trump technically can plead the 5th - that also means the jury can assume he is hiding something that would prove his guilt and rule in favor of the state.

Was Hannity one that was even pushing it? I seem to recall him even being reported as telling them to lay off the election fraud talk... I never really pay attention to the idiot so not sure how much he pushed the fraud claims.

I can't say that he "pushed it" or not. But I can say that he did nothing to NOT push the narrative and to actually speak the truth/report news.

They have no defense. They can't prove that anything their guests said was true, because none of it was. So far as actual malice, many of the assertions made by their guests could have been debunked in 2 minutes with google. Let alone the research staff they have at Fox News. Then several admit they never believed any of it.

It's only a question of the amount of the damages award.

Everything I’ve read about this case has said something to the effect of ‘these cases are very hard to win. That being said, if anyone is going to win one of these cases it’s Dominion here’

Listen.... No ONE in their right mind would believe ANYTHING that comes out of the mouth of Fox News. Even Fox News loyal viewers do not believe 99 % of what they hear on Fox News.
What Fox loyalist do believe is to say anything if it pisses off a Biden liberal. Say anything at all.
Sure... claim that Biden didn't really win the election. Claim that foreign countries controlled that election. Claim election fraud ran rampant. Say anything, no matter how outrageous and especially if it pisses off a democrat.
They shouldn't call it FoX News, they should call it the piss off a democrat hour, which is all it really amounts to.

Many defamation cases against the press and/or public figures are hard to win. Not all of them. Alex Jones never had a chance. I read through the filings in this case. I don't think these defendants have much of one either.

The reason these cases are often hard to win against the press is that the press is usually at least somewhat careful. Enough to avoid "actual malice" which amounts to recklessness in their coverage. But this is Fox News.

Hopefully Murdoch having to cough up several billion will rein them in.

Whatever lies, misinformation, disinformation, half-truths and dog whistles FOX broadcasts are meant to assuage the "FEELS" of their audience. Facts don't matter to FOX fans. It's the confirmative orgasmic sensation they get from listening to and visualizing what their exclusive source of emotional satisfaction is injecting into their hearts and minds.

Those lies that are persistently broadcast by FOX is a drug, and a very habitual addictive one at that. It doesn't matter what this drug is being sold as, all that matters is what kind of awesome high it gives the addict. Innocent folks get sucked in, get addicted and they are now lost in the haze. What's worse is this drug gets passed around freely with no laws in place to prevent its spread. It's all word of mouth with absolutely no reason nor cure to be had other than flushing it all out cold turkey and what addict would ever want to do that when they can simply ride the high into oblivion.

Such is the state of affairs that the working class Repubs find themselves in. Addicted with no apparent reason to get clean again. Anyway, to be cleansed is to be a traitor to the den of addicts so why even bother.

Right-wing social media is all about coming up with the craziest rhetoric about liberals on order to prove your loyalty to the right-wing tribe.
And Fox news and other right-wing media are falling over themselves to do the same for their viewers.

The end result is a continuous escalation of self-serving BS until consequence finally puts stop to it.

The problem here is that the monied interests fueling the GOP are now at the point where they are simply betting all they have left on upending democracy in the US and establishing their fascists hegemony for as long as they can imagine a livable future on this planet. whatever couple of decades that manages to be if they actually achieve their Utopia.

I don't think they really care about winning these lawsuits or losing their shirts over it, because they probably see themselves in the End Game now: If they can get Competent Trump elected (De Santis, I guess), and with the braintrust that they already have in Congress and obviously littered throughout the federal court system, the would be only a few years form ending Constitutional law in the United States. It really is the only goal they have, and they are betting everything on achieving that so that they no longer have to worry about pesky things like "truth" or "law" or "morality and decency" or "brownish people" or "The United States."

I'm not exaggerating. This is their only goal.
