This is going to trial in April. Just wait, Fox News will be arguing absence of malice, and trying to minimize Dominion's damages. What they won't be arguing is that the things said on air were true. And the conspiracy nuts will take no notice, that a corporation with billions to spend on its defense doesn't even bother arguing that the election was stolen.

Any idea what default judgement may look like?

Consult a real attorney (like @woolfe9998).

But I know they don't automatically get awarded the damages they seek. I imagine in this case if a default judgment was rendered (assuming no settlement) they would have a trial to decide on damages only.

As with Alex Jones, Fox News would forfeit its right to defend itself on liability, and could only contest the amount of damages.

But that isn't going to happen here. Fox News is playing some games in discovery, trying to see what if anything they can get away with not handing over. But they're not going to default. This is going to trial, where Fox News will contest liability by claiming absence of malice, i.e. "it's not our fault those nutballs said those things on our network." And second, they will contest Dominion's compensatory damages claims. But as with Jones, defamation can result in punitive damages. If there is a finding for punitive damages, Fox News could be seriously screwed here.

So people at Fox were texting each other like mad that they knew what they were saying wasn't true but do more of it anyway because uh Newsmax. Exploding corporate legal brains aside some of this stuff is just amazing.

Dominion might actually prevail and the trial is going to be lit.

Not only do I hope Dominion wins a bunch of money but I hope they stick to their guns and make Fox admit publicly via print and TV and radio that they lied and they acknowledge it.

They shouldn't just want money they need to shame Fox because those people deserve all the shame in the world

The sad part is no matter what they admit, how much they apologize, their viewers will believe they where telling the truth and it's the deep state making them do it. Fox news needs their license as a legitimate news journalist revoked and they need to be licensed under what ever license a tabloid gets.

I don’t know, I think this shows something different and probably worse. It shows that Fox is controlled by its audience - the audience demands Fox lie to them and if Fox tries to stop its audience will find another network that will.

As this lawsuit mentions Fox really did briefly move towards telling the truth about the election but then they started losing viewers to Newsmax, who was content to continue lying.

To some extent I agree and I think things wouldn't be like this without Fox promoting it. That being said, I think Fox has lost control of its audience.

It reminds me of the day Republican leaders woke up and realized Fox was no longer working for them, they were working for Fox.

This would be a great alternate settlement.

1. Fox pays all legal bills for Dominion.
2. Fox must admit on the primetime air they lied about Dominion and why. Not Friday.
3. Every host must be fired.
4. Fox News for the next 10 years will be monitored for on air lying and unfounded conspiracy theories to which violations result in immediate stiff fines.

Fox News stars and executives privately trashed Trump’s election fraud claims, court document reveals


The most prominent stars and highest-ranking executives at Fox News privately ridiculed claims of election fraud in the 2020 election, despite the right-wing channel allowing lies about the presidential contest to be promoted on its air, damning messages contained in a Thursday court filing revealed.

The messages, included in a legal filing as part of Dominion Voting System’s $1.6 billion lawsuit against Fox News, showed that Tucker Carlson, Sean Hannity, and Laura Ingraham brutally mocked lies being pushed by former President Donald Trump’s camp asserting that the election was rigged.

In one set of messages revealed in the court filing, Carlson texted Ingraham, saying that Sidney Powell, an attorney who was representing the Trump campaign, was “lying” and that he had “caught her” doing so. Ingraham responded, “Sidney is a complete nut. No one will work with her. Ditto with Rudy [Giuliani].”

The messages also revealed that Rupert Murdoch, the chairman of Fox Corporation, did not believe Trump’s election lies and even floated the idea of having Carlson, Hannity, and Ingraham appear together in prime time to declare Joe Biden as the rightful winner of the election.

Such an act, Murdoch said, “Would go a long way to stop the Trump myth that the election stolen.”

The court document offered the most vivid picture to date of the chaos that transpired behind the scenes at Fox News after Trump lost the election and viewers rebelled against the right-wing channel for accurately calling the contest in Biden’s favor.

Dominion filed its mammoth lawsuit against Fox News in March 2021, alleging that during the 2020 presidential election the talk network “recklessly disregarded the truth” and pushed various pro-Donald Trump conspiracy theories about the election technology company because “the lies were good for Fox’s business.”

I think they are fixing to get a lesson in how the law works and I'm getting the popcorn ready. Personally I'm hoping that Fox and Newsmax will soon be bankrupt.

If the conservative sources for political commentary were to be immediately held liable for any and all falsehoods they air on their media their viewers would be left stranded in the middle of an ocean of facts and truths they would not be able to bear.

Their choices would then be to calm down and join the rest of the nation's efforts at winning the class warfare our oligarchs are waging against the working class of whom represent the vast majority of the nation OR go berserk and stage another insurrection funded and led by those same aristocrats that presently own and operate that so-called "party" of theirs.

Our enemies abroad are hoping and praying for the latter to happen and are attempting to help that along as much as possible, Trump being the best tool at their disposal that they could ever hope for.

newsmax is well in it way to bankruptcy after being knocked off of Directv due to their own greed.

A couple days after the election and with things looking decidedly in Bidens favor...

Fox Hosts Tucker Carlson, Laura Ingraham, and Sean Hannity immediately understood the threat to them personally. Carlson wrote his producer Alex Pfeiffer on November 5: “We worked really hard to build what we have. Those fuckers are destroying our credibility. It enrages me.” He added that he had spoken with Laura and Sean a minute ago and they are highly upset,” Carlson noted: “At this point we’re getting hurt no matter what.” Pfeiffer responded: It’s a hard needle to thread, but I really think many on our side are being reckless demagogues right now. Tucker replied: Of course they are. We’re not going to follow them.” And he added: What [Trump]’s good at is destroying things. He’s the undisputed world champion of that. He could easily destroy us if we play it wrong.

couple months later on Jan 6...

After January 6, trying to thread the needle between the truth and pressure from his viewers and sponsors became even more difficult. Late on January 6, Carlson texted with Pfeiffer that Trump is “a demonic force, a destroyer. But he’s not going to destroy us.” On January 26, Carlson invited his leading sponsor Mike Lindell on his show, where Lindell spouted these same conspiracies on air after previewing them for Carlson’s staff during a pre-interview...


Dominion have their balls in a vice with these texts and messages.
