Bill O'Reilly was just on Chris Cuomo's show on Newsnation this past week attesting this is still a fact.

Just a reminder the tagline for his show was “the no-spin zone”. In light of recent court filings, I think we can all agree that was just utter bullshit.

I hope the capital police sue them next. Fox can’t fend off everyone and I suspect the police won’t just settle for a small payoff

This isn’t a problem for them as Biden isn’t going to sue them for defamation.

That being said I still think this underscores a very real problem for Fox, and conservative media more widely. Their audience DEMANDS to be lied to, and lies can land you in legal hot water. If you don’t lie to your audience though, they find someone who will.

Not Biden specifically but more evidence of their M.O. of putting out lies over the air. Dominion will have a field day going back to the days of birtherism. All the evidence proves a pattern and practice dating back to early 2000s. They used to be way more subtle when they lied.

I remember a host got in trouble when she called the Obamas de facto terrorists by engaging in a "terrorist fist jab" claiming "some people are saying"

Right - Dominion won't likely just stick to how Fox reported on them, they will point out the years of constant known fabrication to show that it's a pattern built up over countless false stories and accusations made by Fox News.

It's not likely they will be allowed to present evidence of prior dishonesty by Fox News. Fortunately they won't need to.

Why not? Pattern and practice with motive? Shows it’s the normal MO of Fox News. Some point during trial Fox will be asked, “why did you lie to your audience?” There needs to be more of an answer then, “we were worried our viewers would leave for Newsmax”.

Even if they don’t let it in, time for the other networks to pull out the cacophony of Fox Lies and run then during trial coverage. It will be a massive dump.

From what I understand prior bad acts are only admissible if the defendant opens the door by claiming they have never done anything wrong. Or something to that effect.

Otherwise it is not relevant to the case and prejudicial.

Seems the prosecution can put Sean Hannity on the stand and start by asking, "have you ever knowingly promoted a conspiracy theory that you knew had no basis in fact?"

That first answer can open up the Pandora's Box in court.

The matter of her possible disbarment is going to trial in Texas in April. It was previously set for trial last October, but there was a continuance. The state bar wants her disbarred and have filed suit, but ultimately the decision belongs to a judge. So far the judge assigned to the case refused to dismiss it pursuant to a pre-trial motion last June.
