Driver Charged with DUI after Toasting Officers with Beer

Decatur (AP) - Some people don't know when to quit. Take the case of a Russellville man who found trapped in a partially submerged vehicle early Sunday in a creek.

Decatur Police officers spotted the sport utility vehicle and found the driver unharmed, but apparently celebrating. Police said 21-year-old Jorge Taverez raised a can of beer and appeared to toast the officers. Police said while they waited for firefighters, Taverez drank a few more beers and even turned up the music before water got into his vehicle's electrical system.

The vehicle was pulled and Taverez was charged with D-U-I and other offenses, including littering.

I guess if you are attempting to drive in a creek, you don't have to buckle up

It is law in Alabama as well to buckle up.

It might have been very smart of him to drink the beers in front of them. He can claim he was sober when he went into the creek and that the alcohol in his system is from the beers he drank in front of them. Not sure how it will hold up in court, but it might be worth trying.
(and no, I don't condone drunk driving)

I thought the same. But at least in some states, they can charge you with DUI just for being drunk in a vehicle with the keys. Nevermind that the vehicle was in a creek at the time.

IIRC, there was someone here who was sleeping in his car because he was too drunk to go home, and he got a DUI.

IIRC, there was someone here who was sleeping in his car because he was too drunk to go home, and he got a DUI.

And I bet this guy was too drunk to keep his mouth shut, too.

what are the DUI laws? are they the same all over or do they differ?

my sister's BF has like 2 or 3 of them and his license is gone I assume, but he doesn't seem to have spent much time in jail. He still drinks and drives though...

how many times does someone have to do this to get put away for good?

I swear he just got back from the grocery store and then he lost control of his vehicle. Landed in the pool of water, and decided to say "screw it im getting drunk"

Judging by most news stories, it seems to be unlimited.

AFAIK it's not an offense that can put you away for good until you kill someone...even then, can you get life for manslaughter?

Theres was a story of a guy in the twin cities who had like 23 DUI's...that was a number of years ago though. There was a lot of pressure on the state legislature at the time to pass a bill to do something about people like him but I'm not sure if they ever did.
