A Westbrook woman faces assault charges after confronting a teenager who was using a drone to film above Hammonasset Beach. Andrea Mears, 24, was charged with third-degree assault and breach of peace after an investigation into the May 12 encounter.
A video posted on the website Photography is Not a Crime shows the woman calling 17-year-old Austin Haughwout a pervert, striking him and ripping his shirt.
“You’re assaulting me,” Haughwout says in the video.

If I were her and had "caught" the drone due to it crashing or attempting to land near me....I would have simply kept it.

Aliens spy on us way worse than 17 year olds.

That would be theft, the owner would get out his cam, videotape you with it, and get your information when you got to your car or of you destroying it, and you would get fined or sued.

I have the right to fly a drone in your back yard and there isn't a thing you can legally do about it. A buddy at work has his POV goggles and it records everything he does so there would be that evidence as well.

kids got some restraint, after getting "assaulted" like that i probably would have lost my temper and gave her a quick gut punch at the very least if she could not tell from my attitude and body language for her to basically fuck off and that hitting me would not be a prudent idea.

i do think he has a trolling aspect to his life, that or hes a complete fucking pussy.

No you don't. I own my land and all the airspace straight up the sky. Only the Federal govt. and anyone licensed by them can legally fly through there. Your drone would be trespassing. Also I have an expectation of privacy in my home you can't violate legally.

If the lady in the OPs story was in public she had no such right to privacy.

that video really pissed me off. glad the crazy wise and beautiful woman got thrown in jail hope it cost her a lot of money in bail and legal fees and hopefully a nice fat fine by the judge.

You do have a right to privacy and to enjoy your property but you don't own the airspace straight up.

In 1926 the U.S. Congress passed the Air Commerce Act, which declared that the "navigable air space" of the U.S. was a public highway, open to all citizens. Navigable air space was defined as the sky above "the minimum safe altitudes of flight" as determined by federal regulators — typically 500 to 1,000 feet above the ground.

U.S. Supreme Court in U.S. v. Causby (1946). The court laid down a new rule: you've got air rights only insofar as they're essential to the use and enjoyment of your land.

It would not be illegal for hang gliders or paragliders to glide around over your property.

The FAA is still trying to settle the issue of airspace for commercial (Amazon) unmanned aircraft. http://www.faa.gov/news/press_releases/news_story.cfm?newsId=15334

For now, I'm pretty sure, the FAA has no authority below 700 feet and class G space, from the ground to 700 or 1200 feet is legal for amateur drone pilots.

I don't think you are correct. The land is yours, its not trespassing unless the drone/copter, whatever actually lands. That is how it was interpreted in Topeka at any rate. Also can't go inside any structures.

The sad thing is normally women can assault men all the time and the guy gets thrown in jail no questions. It's only the rare moment when there is a camera or witness that the man get's off.

A remote-controlled aircraft owned by an animal rights group was reportedly shot down near Broxton Bridge Plantation Sunday near Ehrhardt, S.C.
Steve Hindi, president of SHARK (SHowing Animals Respect and Kindness), said his group was preparing to launch its Mikrokopter drone to video what he called a live pigeon shoot on Sunday when law enforcement officers and an attorney claiming to represent the privately-owned plantation near Ehrhardt tried to stop the aircraft from flying.
"It didn't work; what SHARK was doing was perfectly legal," Hindi said in a news release. "Once they knew nothing was going to stop us, the shooting stopped and the cars lined up to leave."
He said the animal rights group decided to send the drone up anyway.
"Seconds after it hit the air, numerous shots rang out," Hindi said in the release. "As an act of revenge for us shutting down the pigeon slaughter, they had shot down our copter."
He claimed the shooters were "in tree cover" and "fled the scene on small motorized vehicles."
"It is important to note how dangerous this was, as they were shooting toward and into a well-travelled highway," Hindi stated in the release. He said someone from SHARK called the Colleton County Sheriff's Department, which took a report of the incident.
The Colleton County Sheriff's Department filed a malicious damage to property incident report.
According to the report, Hindi told the responding deputy the group's remote-controlled aircraft "was hovering over U.S. 601 when he heard a shot come from the wood line. The shot sounded to him that it was of small caliber."
The incident report went on to state that "once shot, the helicopter lost lift and crash landed on the roadway of U.S. 601."
The deputy noted in the report that he was unable to speak to anyone at Broxton Bridge Plantation following the incident.
Hindi estimated damage to the drone at around $200 to $300.
Hindi said he will seek charges against those who shot down the drone.
"This was SHARK's first encounter with the Broxton Bridge Plantation, but it will certainly not be the last," Hindi said in the release. "We are already making plans for a considerably upscaled action in 2013."

There's a need for a rewrite of what constitutes "airspace". If someone wants to buzz a drone around take random pictures at a distance for photography purposes I have no problem. If however the purpose is surveillance or stalking, then no. If someone decides that they are going to fly a drone into my backyard and have it hover and follow kids around then what? Hanging ten feet away from everyone or closer? An inch above the ground is airspace?

If this is correct then flying into my backyard won't fly It's not just a matter of height above the ground, it's the "enjoyment" aspect which applies. You fly outside my window and start taking pictures? Your drone is gone if I can get at it.
