You're an idiot. In NY, DWI is 0.08 BAC. I believe 0.04 BAC is DUI. Zero tolerance occurs at 0.02 BAC.

In NY DWI is 0.08, DWAI (new name for DUI) is 0.05, and 0.02 is Zero Tolerance.

He may be a little off, but not an idiot. Most people can operate a motor vehicile below 0.08, so DWAI are much rarer then DWI unless its obvious or the cop is gunning for you.

That being said, I highly advise any person who has had a single drink to not step into a vehicle.

I was in a bar a few years ago at new years... I used to party and drink a lot then and knew I was right on the edge of being sick (but the good side of the edge). They had a brethalyser machine there. I had to stop blowing cause I was laughing so hard once it hit .42 (not .042... .42). I didn't even finish.

There's no way I could get anywhere near that right now though.
