I got fined 500 dollars, and had to get someone to pick me up from the check point. no jail time. but like 5 points against me.

Lucky. Colorado is usually pretty stiff when it comes to penalties. Did you get a desk appearance ticket? if so... this is what you're looking at:

DWAI First Offense―8 points toward license suspension; $100 to $500 fine; two to 180 days in jail; 24 to 48 hours community service.

DUI First Offense―Automatic suspension of license for up to a year; $300 to $1,000 fine; five days to one year in jail; 48 to 96 hours community service; alcohol education for three to nine months.
The penalties increase substantially for repeated offenses and, in some cases, you may be required to install an ignition interlock device on your car. That means your car won't even turn on if the device detects a certain percentage of alcohol in your breath.

Also, the OP apparently failed the concept of 'variables' in his calculation. 170, short and flabby... probably passes. 170, skinny or ripped... probably going to jail. At least you looked good doing it.

I'd have to guess... driving, 2 in the morning, post St. Patty's day.

Yeah, kudos on not getting wasted like some a-holes, but driving at that time, on a notorious drinking holiday... you're just asking for it.

Yeah... I they should move the DUI limit back up to .10 .08 is too low. Also each person metabolizes alcohol a little bit differently, so that calculator you used is just an estimate. I went home saturday from the St. Paddy's Day bar loop where I live. My friend drove and we got stopped at a check point. We lucked out though and they didn't test us. It would not have ended well if they did since we had about 6 drinks in a three hour period and my friend weighs about as much as the OP.

I can't tell you how many times I have been through checkpoints and never got tested. Luck of the Irish I guess.

Trust me when I say that the cops wasted their time on this one. It was St. Patty's Day. Someone who would have blown a .2 and puked up green beer drove by while they were wasting time here.

That seems extremely light. You got very lucky if that is all you have to pay.

My personal limit is 1 per hour, but even then, I usually don't chance it because I am a lightweight with alcohol. It affects me much more and more quickly than most other people.

with my weight, i can drink up to 2 an hour and still blow a .070. Fucking .001 over, my luck is fucked.

.081 ..... .001 more than the legal limit. i had 6 drinks over 4 hours and i weigh 170. i did the math and figured i was ok to drive.

You are not good at math. Apparently, your body can barely take 1.5 beers per hour and just be legally drunk.

I would contact a lawyer and ask questions about the accuracy of their testing equipment and how it holds up in court. A 0.001 over may be able to get dropped if a lawyer helps you out.

Proof, I demand proof.

I may be more impaired while screwing around with an ipod/phone/etc, but that is temporary. Typically I only do such on long straightaways where I can lose some of my focus but nothing bad will come of it. Driving under the influence is kind of an all trip affair.

For the record, I do not text message while driving, I rarely take phone calls while driving, and I don't own a media player. All I can do is fiddle with my radio... which I think have been in cars a few years now.

Did they have you blow in a PBT (portable breathalyzer) or did they have a full blown Intox machine on site?

PBTs are notoriously unreliable and can only be used with any kind of accuracy about every 20 minutes or so.

What was stupid, was doing it on amateur night. St. Patricks day, along with New Year's Eve are 2 of the worst times to drink in public. .08 BOC? Who gives a shit. I'd have been perfectly comfortable riding in the car with him, but it's best to avoid the crap altogether on some nights.

You do realize at checkpoints there are more than one police officer, and it's not like they let others pass when they stop one of them.

I love all the people in here justifying what he did. Likely they attempt the same "math" the OP did. :awe:
