OP may be able to get out of depending on the laws of his state. In NC , you blow a .08 your pretty much done for. The other option is to refuse, then you have an instant 13 month suspension of your drivers license.

OP made an informed decision to drink and drive. Play with fire and you will get burned. The .08 rule is imperfect but for now it is the best we have. Yes, some people can be perfectly fine at .08. Others are not. Move that to .10 and the situation gets even worse. I just don't understand why people want to fight for a higher BAC for driving, if you want to drink get a DD or a cab. Personally I wish the would move it to the limit for commercial drivers, .04. Drinking and driving is just to dangerous a combo.

I agree texting and driving are dangerous, it is also outlawed in many places. Hands free phones also mandated in many places. In the end it is up to the driver to operate the vehicle safely. No matter what you do that makes you unsafe, you screw up and kill someone your the one going to jail.

OP, think about this. You were driving last night and someone runs a stop light and you hit them. There are no other witnesses. The driver dies and the passenger says they had the green light. They are sober you blow a .081. Who do you think is going to win in court, the sober person or the one with a six pack running through their veins?

You are not good at math. Apparently, your body can barely take 1.5 beers per hour and just be legally drunk.

I would contact a lawyer and ask questions about the accuracy of their testing equipment and how it holds up in court. A 0.001 over may be able to get dropped if a lawyer helps you out.

Always an margin of error on the instrument, so yea, 0.001 will not hold up and he doesn't even a need a Lawyer to point that out.

Modern intoxolizers are calibrated before every test and considered accurate in a court of law.

How do they self calibrate?

I don't know, I don't design them. Before someone is tested it goes through a calibration routine. What it is actually doing I don't have a clue. I'm not saying they are perfect, I am saying they are generally accepted as so in court, at least here.

if they actually did some kind of study (not like the governent would ever use information to make laws, that makes too much sense), i would be willing to bet than 99% of drunk driving traffic fatalities are from completely fucking wasted people that would blow two or three times the legal limit, minimum.

well, if they can get time of impact from the car's computers then they could show that the light was red. not that I agree with the OP's actions, just saying...

Impaired is extremely subjective, but it basically means that if the alcohol affects your driving AT ALL, you are impaired and that is a crime.

Obviously, most people can drink and drive fine, but when it comes to an over protective society, they take a firm ground.
If they weren't firm on the limit, the regulation would creep all over the place.
Some places strictly, some places loosely.

That's why the number is there, so people can drink to the maximum allowed by law.

Anyways bro, I certainly think that if you think there is even the slightest chance you might have been over, there's no reason to risk it.

This is wrong. The "legal limit" is the point where your BAC alone is enough to prove you were driving while impaired. Even if your BAC is under the legal limit you can get a ticket for DUI/DWI if you exhibit evidence that alcohol impaired your driving (e.g. inability to stay in your lane).

Obviously this all depends on what state you're in.

The issue isn't with the limit the issue exists with the tenacity with which law enforcement seeks to enforce the law. In many states, though the limit my be .08 you can still be arrested for driving impaired under .08!
