the OP got screwed....the drunk tank is the best part of a DUI. Right now he just has a really shitty story to tell. If you're going to spend that much money, you should at least have some good drunk tank stories.

I don't care if you went home and drank another case of beer. I probably would have done the same thing, big whoop! How old are you btw? 20s? Just curious. Everyone condemning you probably didn't live that sort of college life. A lot of us did, and almost everyone I know has probably driven when they shouldn't have. As long as you aren't making a habit out of this, I think a 1 time .081 shouldn't ruin your record and insurance rates for 3+ years.

Also, I know it's weird, but I've seen .04s act drunk as $hit and couldn't have driven a big wheel across a driveway. Then I've seen .12s act perfectly normal and could probably drive a big rig down lombard street in san francisco (big obviously shouldn't). I understand the .08 thing though, aboslutely I do.

I totally understand if he wants to get drunk on St. Patty's Day. I like to have a few drinks on a holiday too, and I'm just an ordinary guy. But it's incumbent upon him to not drive if he wants to do so. He either stays at a home to drink (his or a friend's) or has a safe ride home from the bar.

You're only defending him because I know you've posted here about getting a DUI before. Not very responsible of you, Slim :thumbsdown:.

I could do what the average person would call higher level math while drunk (as can most here probably)... basic multiplication and subtraction should be no problem even for the average student.

%BAC = (A x 5.14/W x r) - .015 x H

Using the numbers he provided:

A=6 beers = 12oz*.05=.6; 6*.6=3.6
W=170
r=.73 (male)
H=4 hours

I worked this out with a calculator to be 0.089. This is over the limit. It's probably within the range of error for the breathalyzer, since the OP didn't give more specific numbers.

I agree, it's not a particularly difficult formula, but I'd argue it's more difficult to do in your head, even sober.

I stick to the 1 drink an hour rule when I'm DD.

As for all of you siding with the OP...I'm sure if the OP had ran into someone after having his "measly" six drinks you all would be singing a different tune.

Consider yourself lucky, you probably got off easy. I just saw a local blotter where a 19 y/o got DUI for 0.024, and got jail time. And one where a 20 y/o was convicted of vehicular homicide for an accident where she was 0.075 and crashed her car killing her passenger. Looks like she will get several years.

What's the tolerance on a breathalyzer? There's no such thing as "exactly equal to" when measuring something. Is it +/- 0.001? +/- 0.0001? \

Of course, you're lawyering up, so probably shouldn't have a huge problem.

This varies from state to state, but in Pennsylvania, .02 is the DUI limit for underrage.

No, not 0.24, 0.024 one quarter the legal limit for over 21, but in NJ the legal limit for under 21 is any detectable etoh.

The record in my ER was held by a homeless woman who routinely had blood levels over 500mg/dl (0.5). She came in once with a level of 745mg/dl (0.7). Obtunded but arrousable and breathing on her own.

no accident or anything? Thats crazy to jail a kid for making a mistake that didn't hurt anyone. There are better ways to punish someone for this.

At least you didnt get in a bad wreck and kill someone. Even if it wasn't your fault, you would be doing about 7 years in jail

Sure they can, but realistically, its uncommon.

A true alcoholic with a physical dependency on alcohol is very different from the person that drinks too much or too often. Actual alcoholism is a chronic addiction that takes time to develop. I knew a lot of very heavy drinkers in college, and only one of them had true alcoholic tendencies - but even he was in the low stages of it.
