Uh no he wouldnt hes entitled to a recount. Its not the same as sueing for a recount. The state automatically has to recount if there is less than 1% difference.
What is interesting is they will be counting all the provisional ballots tomorrow. In any event, it appears VA is likely to determine who is going to control the Senate.

Uh, Montana and Missouri are both looking like they are dem, which means 50-49. VA is going determine control of the Senate. If Webb wins, its 51-49. If Allen wins its 50-50, which Cheney being the tie break. Ultimately the Repubs control in a 50-50 split, but there will be powersharing.
