eBay and the DMCA

Would it be possible to force eBay to take other people's auctions down when they have stolen your item description and pictures from your own auction using the DMCA. I find it much more entertaining and productive to just change my picture to something less appropriate after my auction ends, but this might be a case where we can use the DMCA for our own benifit.

Can you think of any other situations where the DMCA could be used for our gain?

DMCA = digital millenium copy right act = you cannot circumvent copy protection technology

example: guy creates a program that circumvents copy protection on divx/dvd so he can watch em on his linux box...he gets his a$$ in a lawsuit

The DMCA allows a copyright holder to force someone else to remove their copyrighted material from that person's web site. For example if you used various star trek logos on your website Paramount could and has come along to force them to be removed. This is not a eBay question. It seems that the DMCA has mostly benefited powerful organizations that lobbied for it. It is a question of wether the DMCA can be used to benefit us as well.

Good to ask ebay questions here. Ebay forums are highly censored. Posts deleted for even the slightest criticism, accounts deleted, etc.

Copyright law would take presence over the DMCA.

I have a clause in my listing that prohibits such. If I see someone rip off my listing, I'll buy the item and serve him with a subpoena at the same time.
