Ebay/Paypal Dispute - What does ATOT think?

Ok, so I bought some baseball tickets on ebay from a buyer w/ 100% positive feedback w/ 77 transactions.

After winning the auction I logged into paypal and selected the correct shipping address (I have several in there since since joining ebay I've lived w/ my parents, several college apartments, two other places, and now my house). I double-triple checked that I selected the right address because I've had issues with this before.

So I go thru checkout and the address is right. I get a receipt from Paypal and the shipping address shown in that email is right.

The guy ships the package via FedEx and provides tracking. Then yesterday I check the tracking and it shows as delivered. I checked my porch, under the door mat, etc...nothing. So I called FedEx to see what address they shipped to and they told me...

It was an old address.

The seller claims that it was the address that Ebay gave him and that he never checked the Paypal transaction details he was emailed after I made payment.

I am not sure how Ebay sent the wrong address because the Ebay transaction details I see show the correct address.

I told him I want a refund but the seller says he "followed the rules" and will not issue a refund. The way I see it, the seller (to be protected) should ship to the Paypal confirmed address that shows on the receipt.

Who's right here?

If he shipped to the address Ebay provided to him, he's done. You should have removed that address from Ebay.

I would have to agree with the seller on this one. There are instances where I never check the paypal details. I just go through ebay, click order details (in ebay), get the address, and send to that address. It is the buyers responsibility to keep all his addresses current.

Yeah, unfortunately I've had this happen before and had to remove all addresses from eBay to prevent it from happening again.

eBay is wrong then. Withdraw all your money from Paypal and try out their arbitration clause since you can't go to small claims court directly I'm sure.

I did this before. Had to chalk it up to my own incompetence. Found the people living at the old address and asked if they had gotten a package, luckily they were nice and understood what happened.

Well whats confusing is that Ebay transaction details show the correct address. It makes no sense to me how he was even given the wrong address.

I know my old address is still in there. I should have deleted it (and I will after this is all cleared up). But the transaction details on Ebay and payment details on Paypal both show the correct address.

I don't even know how the seller got the wrong address.

You are not at fault, Ebay is at fault because you have to go through so many layers on their site just to find out basic info. If I were you, I would open up a dispute in paypal.

I opened a dispute but my confidence in Paypal is very low. I guess we'll see.

Is the old address close enough that you can drive over there to talk to the prople that got the tickets? Have a friend in the area?
I wouldn't file a dispute because the guy sent the tickets to your address. He lived up to his end.

if the address is correct on the ebay transaction and paypal receipt, then the chances are you will get your money back.
Paypal usually sides with the buyers on everything.
As a seller, I know that paypal will side with the buyer 99% of the time. even if I give them all the info and explain in full detail about the situation.

You left your OLD addresses in ebay. That was your fault. You shouldn't expect him to pay for ebays error

I would try to see if he'd split the loss with you. I ONLY send auction items to the PayPal address, because it's my understanding that the only way to be protected by PayPal is if I ship to that address and keep tracking information to prove that I did. Since the seller didn't do that, I would think you would win a PayPal dispute. Thus, I would try to get him to settle for half.

What if I had two address for other reasons? Would that be my fault? The fact of the matter is, the Ebay transaction details and Paypal receipt show the right address. As a regular seller on Ebay I always go off of the Paypal address and I can't imagine doing anything else.

I'm not saying it's entirely his fault, but I don't see it as my fault either. I provided him with the correct address in two locations and somehow he acted on bad information instead. The seller has yet to explain how he accessed the old address.

I was thinking of offering this. It was $150 so we'd each eat $75. I guess that isn't bad.

My issue is, I really don't believe I am at fault as I was very careful to ensure that the Paypal would carry with it the correct address.

I think Ebay screwed up here (somehow) so I feel bad for the seller taking the full loss also. But I hate taking a loss for something that wasn't really my screw up.
