thats what im thinking, and from what i understand the buyer pays shipping for returning... but find it hard to believe paypal can help since he is refunding me.
ill take some action and see how it goes.

...have to wait 10 days to take action ~4 more left.

9 times out of 10 a last minute seller back out due to broken/damaged/lost goods is themselves avoiding a reserve auction/fees and then their item selling for too little. Also even with Buy it nows the seller may have targetted too low. I have had this happen ALOT...swooping in to score a deal only to have the seller flat out admit they want more for it now that they checked other auctions/had offers after I won.

1. You bought it, nothing wrong with it. You want to return it AND the eBay seller's policy allows for such: you eat shipping BOTH ways

2. You bought it, something is wrong with it, and it was 1) the sellers fault and 2) not disclosed in the auction. Seller gives you return shipping + full refund including shipping

3. You bought it, seller emails you telling you that it's broken, you tell him to ship it to you anyway, then it arrives broken: you're shit out of luck

it has rarely happened to me, 1 in 50 at most. people eventually comply but this guy has no feedback to defend.

sometimes items are hard to find, and when i win the auction (needless to say by staying up till 4am) i expect to get whats due.

There are other places online that sell penis pumps... My advice is to let it go and move on.

I've had this happen a few times and I just let it go. If the guy's an eBay newbie, he might not have known about reserve prices, or his reason could be legit and the player is defective. At worse I'd give him a neutral or negative, but going after the person and forcing them to ship seems kind of ruthless. Since he's a new user, a negative would screw him over good enough and probably teach him a lesson about backing out on auctions.

hmm. i am usually flexible. but beyond people not sending the item or list a bad item, what i cant stand is when they dont bother to respond. communication is something i take seriously when doing any transaction.
if he contacted me beforehand, and consulted me about a defective item we can always come to an agreement. just refunding the money is kind of disrespectful.
may just be me but its just bad business ethics.

i recently had to return fake headphones, even lost money on shipping them back. but the seller was quick to respond so i didnt make a big deal about it.
if i hear back from this guy then we can go from there.

i recently have stopped using ebay, but it has really improved over time... still a pain though. i dont know what i would do without craigslist and forums.

you can leave him a neg, but wait till may 19 - that's the date that sellers can't leave negs for buyers. otherwise expect a retaliatory neg if you do it before may 19.

Err what are you asking exactly? If you got a refund, you should be happy...

That whole "seller is obligated to send an item" thing doesn't work in real life. All you have to do is say that you reserve the right to sell the item locally and you're SOL anyway.


From legal stand point of view, the notion of "bid is a contract" works in the form the perspective of the seller. If your bid (or offer) is accepted, then, assuming that all the other requirements of a bilateral contract are satisfied, you have to pay up.

On the other hand, all auctions are considered to be with reserve unless otherwise stated (see "Lim v The.Tv Corp. International"), so the seller has the right to reject all the bid in the end.

I was responding to the notion that the Seller is responsible, not the pratices from retailers you have experience with, since you did not mention that. Legally, the buyer is responsible for return shipping, but that does not mean the seller can't pay it. However, your experience is unusual. I think you will find that few others can say the same as you regarding who has paid return shipping.
