Absolutely. I think very few people would scoff at 38%. Legally, she needs at least 1/16th to entertain the claim that she's Indian absent the ability to point to a specific lineal descent. Most tribes are still a bit stricter than that, but since that's the point where it's at least possible I think it would be fair to give her some benefit of the doubt. The further past 1/16th, the more benefit and the less doubt.

If she wants to identify as one, why isn't she pursuing membership with any tribe? From my knowledge, she has never lived on a reservation nor has tribal membership.
