As my post states, according to Snowden a legal opinion was issued in 2011 (IIRC) stating that expanded 'spying' on US citizens was legal/constitutional. Ordinarily this would come from one of two places: the AG office or the WH counsel's office.

with the slim chance that republicans will take over the senate this november, berrie and hairy have a very small window of opportunity to shove thru any nomination as a replacement they want (now til jan 1st 2015). should the democrats lose the nuclear option simple majority vote it would obviously put a crimp in their ability to ply America with another activist ag. hence the timing of holder's departure.
