Can give you my understanding of the US Constitution.
Originally there was a requirement that the exact oath as enumerated in Article II, Section I, Clause 8 be said before a president could become president.
However, this has been superceded via the 20th Amendment which states that the prior president's term automatically expires at 12:00 noon on January 20th and the new president's term begins immediately thereafter.
