Shouldn't we have the right to have sex with whoever we want, as long as the people are consenting adults?

As for the child with birth defects, why are relatives held to a higher level of responsibility than say smokers?

I would agree that there should be laws regarding parents engaging in things that are known to hurt the child like smoking.

The logic behind not allowing incest is because of the health of the possible child. We in society scoff at it because it seems disgusting, but there is a valid reason for making it illegal.

Father and daughter were performing an illegal act that led to the defect of the child. If a mother smokes crack while pregnant, she doesn't get to keep the child either.

Also, if a mother drinks alcohol or smokes, there is a case to be made to take that child from her as well.

And, the rate at which a mother gives HIV to her child is extremely small, to the point of not even being worth mentioning.

I'll bite on the troll thread. I think incestual sex should be legal; it's no business of the government who anyone chooses to engage in consensual sex with. However, I fully support making pregnancy resulting from incestual sex a crime. There's too great a risk of genetic problems associated with incest, moreso than smoking or drinking or other vices that can potentially harm a fetus. So, yeah, fuck who you want to fuck; you aren't hurting anyone. But you don't get to create a deformed life that will permanently suffer from your actions, because that is doing demonstrable harm to a separate person. Get your tubes tied before you bone your father.

With proper medical care HIV transmission rates are less than 1%, so hardly the same risk factor.

In the linked article the appeals court contends that the baby was taken not just for being a product of incest but due to mother's drug problem and other irresponsible lifestyle issues, and I'm sure the father's current incarceration also played a role. The poor judgement shown in maintaining this relationship only added to the determination that she was unfit to raise children.

I don't think incest should be as broadly illegal as it is though; sexual activity that can't result in childbirth shouldn't matter (but apparently in Oregon it does) nor should any activity if one or both of the participants are incapable of having children.

You look over the court documents linked in the article, and you get this little nugget:

Prior to the jurisdictional hearing, and in exchange
for the dismissal of the other allegations against her in the
petition, mother agreed to admit the allegation that she
“has another child for whom she is not a parental resource
and the conditions or circumstances that were the basis for
the mother not having custody of that child, which include
the following: mental health issues, substance abuse, and
limited cognitive abilities, have not changed or been ameliorated
and interfere with her ability to safely parent the
child.”


So, really doesn't much seem to matter if they're related. Custody was taken away because being she's still a mentally ill, mentally deficient substance abuser, none of which has changed since they took away her last child.
