WTF is wrong with this country?

HOUSTON (FOX 26) -
Clifford Hall says he's more than happy to pay child support for his 11-year-old son.

"I'm his father it's my responsibility to take care of him," Hall says.

But Hall says when the amount of child support was modified no one told him.

"I discovered for some reason his employer was withholding a large amount some weeks a small amount some weeks a zero amount some weeks," says Hall's attorney Tyesha Elam.

"I didn't want to go to jail basically," Hall says.

So Hall quickly paid almost 3 grand in back child support.


When Hall and his ex were in Judge Lisa Millard's court last November he owed nothing.

"Opposing counsel testified twice that he's all paid up," says Elam.

But the attorney representing the child's mother wanted Hall to pay her three grand in attorney fees and Judge Millard agreed.


Court documents also reveal Hall wasn't following the court's scheduled times to pick his son up for visitation.

Another modification Hall says he knew nothing about.

"The Judge ended up sentencing him to 6 months in jail." Elam says.

"When she said I remand you to the Harris County Jail for 180 days my mouth just dropped," says Hall.

"This entire situation is shocking to me," says community activist Quanell X. "I've never seen one like this."

Quanell X wants the state's judicial board to investigate.

"The court failed the child," he says. "The court failed Mr. Hall the system broke down."

"I'm like he couldn't have gotten a worse result," Elam says. "He could have gone in there with a monkey and gotten a better result. What did I do that my client has over paid over visited and is now paying 3 thousand dollars in attorney fees and is going to jail for 6 months."

"I can't be there for my son in jail," Hall says. "I can't pay child support in jail. This is not in the best interest of the child."

Judge Millard tells Fox 26 after she found Hall in contempt he walked out of the courtroom which she says is a big no no.

Judge Millard says Hall's attorney could have filed a motion for reconsideration which would have given her an opportunity to hear from both sides again and reevaluate the situation.

Hall's attorney is now working on an appeal.

Hall says in a few days he will turn himself in to the jail.

Both parents have to pay equal amounts into an account. The custodial parent then has to present receipts for expense, such as rent/utilities/food. All receipts will be divided by the number of people in the house....IE, if the rent is 1000.00 a month and there are 2 people living there(Custodial parent and child), then they are given 500.00, not the full 1000.00(why should they get all the bills paid?) Same with utilities---Light bill is 100.00 a month, CP gets 50.00 back. Food is the same---you pay 150 a week for groceries, you get back 50.00 a week.....Cause I know the CP is also eating some of that food....
The non-CP should also be reimbursed for times when they have the child. IE, if they have the kid 10 days a month, then they get 1/2 of 1/3 of the rent money reimbursed(1/3 of the month, divided by 2 people)..Same with food, clothing for school, etc...Each parent gets reimbursed equally.
At the end of the month, if there are monies left over, then that money goes into a college/trust fund for the child. It can be used to pay for college when he grows up(or any other educational endeavor), or it can be released to the child at age 25, if they have no criminal record, and are not involved in illegal activities....
That way it is fair for both parents, and money grubbing ex's can't bleed their ex....

2. Suddenly paying it all back after you've already been charged somehow absolves you?

3. Hire the world's shittiest attorney to defend you.

4. Be charged with contempt, then walk out of courtroom.

That's bogus. It's unfortunate that if you are the guy, you are automatically behind the 8 ball in any state in this country. (Other countries too apparently, lol). Kids need to be supported and they need a dad. It's just too bad that folks don't understand that you have to modify (lower) your court order if you are not making enough money to cover your child support obligations. Basically, you are ordered to pay support regardless of your personal situation. If you lose your job, or switch jobs and you make less money, it is your responsibility to go back to court and bring that to the judge's attention. Not enough people know this. they think it is automatically adjusted. The system is broken because the payor's don't know they have to modify it, or they don't care (guys are stubborn and just say f it), and even if you do know you have to get into court, it takes 5-6 months to get a hearing. It's too bad really.

So now guy goes to jail and no child support during that time. On top of that, guy loses job while in jail and no income?!? Finally, guy comes out of jail and can't get job and then files for lower support. Goes to jail more for not paying the original terms (because in jail).

What a shitty idea by the fucking judge to do....yes, that'll show him. Dumbass!

Seriously, some of these politicians, judges, and lawyers need to be replaced by economists, or accountants, or anyone with some common sense and basic math skills.

A good friend of mine wanted to go back to school and inquired about getting his support reduced during that time.

Big mistake - he was threatened with an increase if he dared to quit his job to further his education.

Actually, better move: don't have kids. Keep it in your pants, until you've grown up enough to be a responsible adult, who can find another responsible adult to then marry and have kids with.

Too often, divorce (and the subsequent custody battles) results from two immature people who get married because they're "in love".....then realize, after a kid or two, that they can't stand each other.

Imagine getting married at a young age. Through hard work you become wildly successful and start earning good money. You have 2 lovely children and the years go by. One day you come home early and you find your wife doing the pool guy. She wants a divorce. She automatically gets half plus a large check each month for child support. What a system!

The judge is corrupt. She deserves life imprisonment without parole and all her assets liquidated to Mr.Hall.
