So if a person does transmit classified material to a person that doesn't have the clearance to have it all they have to do is reasonably show that they didn't know it was classified? I always thought that classified stuff was marked as such or if classified in the future anyone with access was made aware of the classification. It would seem pretty incompetant not to and kind of make classifying the material pointless, then again it is the federal government so incompetence isn't all that far fetched.

That's not really how classified information works in a lot of cases. There are lots of things that are generated by the government that are very clearly marked. There are also other situations where that would be impossible.

Valerie Plame, for example. Her identity was still classified even when it was in the newspapers. If a reporter notices US troops somewhere and reports on it that's very likely classified too despite it being in the news. Because of things like this you have almost certainly transmitted classified information yourself during your life, but you certainly shouldn't be prosecuted for it.

In short, some types of classified information can be absolutely controlled. Most of it, especially world events info, can't be.

Whoah, hold on a minute, depends, on the state, but regardless, I GUARANTEE affirmative consent was not a law when those recordings were made. He may very well have had consent, and it's possible that many of those women who have come forward recently, have retracted their consent based on future findings of his political views, which is their right, but that doesn't change my argument!

There's a difference between classified information & classified documents. Information not marked as classified can reasonably be assumed to not be classified.

I think it was an inevitability that the judicial system would become too powerful for its own good, and its power would trump the legislative and executive branch because they hold the keys to the jail.

I think that the executive and legislative branches can probably bilaterally suspend all justice branch investigations until the justice branch itself is investigated. Russia must be stopped by any means necessary.
