I actually do think he would be fine with employers just firing them.I wonder if Gorsuch would be ok if employers just outright fired antivaxxers? He's already ruled in one case that employers can fire employees who won't die on the job for the employer: https://www.theguardian.com/law/201...-supreme-court-frozen-trucker-alphonse-maddin
Maybe his guiding principle is employees should have ample oppurtunties to die for their employers and by allowing infections individuals to come to work he increases their opportunity?
SCOTUS stands up for workers right to choose. Today is a good day.
Oh I know. They picked the outcome they wanted and then built the legal argument to support it. Doesn’t matter whether that argument was consistent with precedent, the statutes as written, or even from one case to the next.I actually do think he would be fine with employers just firing them.
That being said, this was another case of the legal Calvinball that I've been talking about. There's nothing in the statute or the Constitution that says OSHA can only regulate things that take place primarily or exclusively in the workplace, they just made that up and said the vaccination mandate violated it, despite plenty of other hazards OSHA regulates being present in other aspects of life.

I wish I could take credit for it. I can't remember where I read it first but it did stick with me because it is such a great descriptor. That is the perfect way to describe this new bullshit court, well said.
Stopping government overreach is fascism? lol ok...for fascist hypocrites pretending to give a damn about personal liberty anyway. Pretty shitty outcome for anyone who wanted credibility from this court, or an effective end to covid.
You people live in a damn delusion of your own making, you spew 'right to choose' without a shred of irony or shame. Remarkable, this detachment from reality your kind revel in. I'd ask you to get smarter, try to develop some empathy but if you're cheerleading this shit after almost a million Americans have died from covid, you're pretty much a lost cause at this point.
Well abandoning the rule of law is certainly consistent with fascism, and the rule of law was definitely abandoned here.Stopping government overreach is fascism? lol ok
Trump has totally screwed this country over with his Supreme picks.

I agree to a point. There are people who would love to get the vaccine but due to medical issues, cannot, such as an allergic reaction. We need to find a way to protect those people as well.I've gotten to the poin that I just don't care anymore. If you haven't gotten the jab, and you become seriously ill from Covid than OH WELL.
Its survival of the fittest. Not in the sense of who is stronger, but who can adopt quicker to the new threats. When they look back 100 years from now it will be evident who was able to adapt and who was ignorant and got sick because they were unprotected.

Wait until he gets to pick Breyer's replacement. And he'll somehow get another surprise vacancy to fill next term too. That'll be FIVE picks from one President.

Well let’s see recall capacity of independents in November. As much of a lost cause the 74 million that voted in 2020, let’s see how the deciding voting block will vote to either further hamstring Biden or show they won’t let Repugicans regain any federal power.Let's see what sedition and insurrection have done to America's mood towards the GQP. Hearings will be going public. The majority of people I know who were still republicans in January of 21 have since fled the party. I hope we see that trend from here on out. Treason just ain't cool.
That is absolutely great. So true.I wish I could take credit for it. I can't remember where I read it first but it did stick with me because it is such a great descriptor.
He also said he wished he had more strongly opposed the pandemic response in the beginning. And FL governor DeSantis has already said that FL won't be enforcing the vaccine mandate for health care workers. His press sec said it was unethical and unscientific to fire the many workers who have infection-conferred immunity. I guess we'll see how that works out.

DeSantis says he regrets not speaking out 'much louder' against Trump's recommendation to stay home
Florida Gov. Ron DeSantis said one of his biggest regrets in office was not speaking out "much louder" in March 2020, when former President Donald Trump advised the nation to stay home to slow the fast-spreading coronavirus.www.cnn.com
Deathsantis living up to his name.
While I'd normally advocate a lesson in the supremacy clause, I feel like withholding all federal funding from Florida would change his tune much more quickly.
