SAN ANTONIO — A federal judge in San Antonio has declared Texas' ban on gay marriage unconstitutional.

U.S. District Judge Orlando Garcia, however, also issued a stay, meaning the ban stays in effect for the time being.

At least the ban stays in effect for now.

Um ... because marriage is a social institution that exists in many cultures including those that have no link to the church, predated the church, and can fully legally exist outside the church. If government gets completely out of marriage, then a wife cannot visit her husband in the hospital or make end of life decisions for him. Really, there's hundreds of reasons why the government needs to be involved in marriage because it needs to be a legal status.

If someone decides to live an immoral lifestyle outside the norms of society, what makes you think they deserve equal rights?

So your view of freedom is the freedom to live your life as long as they live it according to your moral viewpoint? Why do you hate the ideals of what the founding fathers fought for so much?

We're talking about relations between consenting adults here not farm animals or toasters.

I have no issue with polygamy as long as all participants are of legal age and making a decision to be in those relationships of their own free will. That relationship does nothing to weaken my marriage which is between me and my wife and no one else.

Allowing laws to discriminate based on sexuality is exactly picking who deserves equal rights and who doesn't. You can't possible be so stupid as to not see that.

Any law that discriminates for any reason is subject to scrutiny as to check if the discrimination is valid or not. A law that prohibits children from drinking IS age discrimination, but you cannot find a single valid case where allowing a 6 year old to consume alcohol is a good idea. You also cannot find a single valid case where allowing a man to marry another man is a bad idea, therefore laws discriminating against sexuality of people getting married will be found unconstitutional. Eventually, (sooner rather than later, we all hope), they will give sexuality the protected status it deserves, along with race, age, religion, and gender.
