The camera idea sounds like a great plan TBH. Legally make his life a living hell. Stay legal, since he wont have anything he can even try to do against you. There's probably already a few things he did you could have him charged for, now to try and record some evidence.

In fact if you can manage it try to find a place so the baby and your GF are safe but still make it look like you live there, somehow, guess by still going regularly.

AND make certain they know that you believe the landlord either threw away your mail, or kept it. If the Postmaster wants, his investigation can include involving the police, search warrant(s), and pretty heavy fines if your LL messed with your mail. It's a federal charge if he did.

I'd also keep a close eye on your credit report for a while, if any bills (or other important mail) failed to show up. Always thought it was pretty foolish of the credit card companies to put your full CC number on the bill, as that would give an identity thief 1/2 of the information he'd need to use your CC.

Oh yeah, and a webcam on your computer, shooting a frame every 30 seconds, would do almost as well as straight video, as it'd be likely to catch him too.

By the way, does the landlord own and rent other properties? Does he have a business license or LLC for his rental spaces? If so, also contact the better business bureau and contact your local TV station that specializes in "on your side" reporting. it won't help take back any of those hard feelings or get you any money back, but it will put a huge frikken spotlight on him.

You need to get some sort of USB pen camera that records sound and video for cheap on Ebay (I have one I bought for $40 shipped from Tiawan) and the next time you see him, turn it on and record the sound and video of what he says. Then download it to the PC, and call the cops then a lawyer. The cops will be forced to do something about any threats made when they see and hear them for themselves. You won't have to wait for a judge to act, they should arrest him immediately. After this happens, immediately take the video to a lawyer and/or judge and have a restraining order of some sort placed on him barring him from the apartment and your presence until you move out. Change the locks, too.

Also, if you can afford it and don't want more direct conflict, you can also install cheap spy cameras around the apt and set him up to get what you want. Tell him you need to go out of town for a day or 2, and make sure he knows you are all going to be gone. Then rent a hotel if you need to and catch him in the act of vandalizing your property. If you use an internet camera system, you can even monitor the apt from a hotel using a laptop. Then sue his ass off in court when you get him on video and most likely force him to sell some of his properties to settle or pay off the lawsuit. Good luck.

Don't forget, in NY, only one party needs to know that a phone call is being recorded. Record your phone calls. If he makes any threats over the phone, then you LEGALLY have them recorded.

Your first priority is to ensure the safety of your gf and child until they leave for Atlanta. Ask friends if they can take turns and stay in your apartment for a few hours or overnight. They will serve as a deterrent and as witness if anything goes down. Heck, I'm sure ATOTers in the area wouldn't mind dropping in to check up on you folks.

Once the gf and baby are safely out of the city, you can worry about the legal tools available to you.

A camera recording 24x7 wouldn't be a bad idea. Even better, get a few fake camera enclosures and fix them around the house, then stick an obnoxious "Under Video Surveillance" sign on your door. They will act as a deterrent.

Not sure you need an attorney at this point since you're planning to leave in less than two weeks. I'm barred in NY but work in DC... otherwise I'd volunteer to help because this is nonsense. If you're actually fearful of this guy (and I probably would be with a newborn in the house), you could try to get a TRO against him. I'd ask the housing authority if they are in contact with any agencies that have lawyers willing to do pro bono representation. If you're in NYC, there's plenty of lawyers looking for some hours to donate.

Unfortunately, this isn't the most shocking landlord/tenant dispute I've seen.

I had a prospective client today that insisted the LL was shooting asbestos and mold at her through holes in the wall. After I looked up her prior 5 evictions and DV record including stabbiing her husband, I decided to give her the number to the local lawyer referral.

OP, I'm really sorry to hear about all this and stay patient during it all. The whole situation will be done when you're gone and you can press charges to show the bastard that it is completely unacceptable to bully anyone, let alone your pregnant (or recently pregnant) wife.

Good luck! I'm sorry to hear that you have to deal with this crap. I'm not sure if it's possible but when the police say they won't/can't do anything, I would try and escalate it to their sergeant.

This asshole is breaking the law, threatening your gf, messing with your mail and utilities. Hope your lawyer puts this loser in his place and makes him pay for your troubles.
