Because unfortunately our court system is fucked up and you can be sued for helping nowadays. If our court/legal system encouraged good samaritans, there would be more of them.

I thought it was the opposite, you couldn't be sued for helping, short of painfully obvious ways to help. E.g. I thought stabbing him would get the bad blood out faster!@

Your quick to judge him when it's possible the boat cover (I think that's what it was) was a possibly a piss-poor design. Not everyone's an engineer and can tell when a strap is going to fail.

it's not really a good idea because you open yourself up to all sorts of possible liability issues. working in insurance taught me that it's best just to call 911 and get out of the way.

Good Samaritan laws vary widely by jurisdiction. In some areas you're covered for anything short of killing a victim by performing an emergency appendectomy with a chain saw and in some areas you can get sued if you stop to help and give the victim a cold by coughing on him. Unless you're sure of where you are and what the laws are there, you're better off calling the professionals.

No, it was a rolled up foam mattress strapped with what, a fucking shoelace? to the outdrive. Just some half ass cargo hanging on by a thread. you don't even see the failed rope or whatever, it is too small to see.
As for the cyclist not reacting soon enough, that thing bounced one way and then another before it started out in the general right drift. It was like dodging an animal with a mind of it's own.
Boat guy should bring out another several thousand.

Damn, he like froze up. I see that someone mentioned he was a new rider, that makes sense.

A more experienced rider would have been able to avoid that no problem, I imagine. Glad he wasn't seriously hurt.

Ok, watching it a few more times.. He didn't freeze up as much as he was just trying to figure out what the foam pad was going to do, and thus.. what to do.

It looks like there are two straps. When it first drops, it's still being held by one. The cyclist sees this and starts right to try and avoid the danger. But just as he does that, the pad fully comes loose and also heads right, and he doesn't react again except to hit the brakes.

Not sure exactly how he could have avoided this other than maybe to speed up and pass on the right the instant it came loose, or stay far left and brake hard. Like someone said, it's a little like an unpredictable animal. He went right to avoid, but it also went right...

For what? Yes, lost some of his cargo...but it's not his fault the motorcyclist was following so close he couldn't avoid it. (Had the load fallen lff and hit the biker, THAT would have been the fault of the driver)

Of course, different states have different laws, but in MOST, the motorcyclist would bear at least a large lortion of the liability in this.

Gotta disagree with you on that one, Boomer. Stuff falls off your car on the freeway, you are responsible for the damages caused. I don't want to get in an argument over it, but it just seems to be common sense.

Guy was definitely a newbie rider. It took him a long time to start braking and looks like he didn't brake very hard. And sports bikes are much more nimble than that sloooooow drift he made into the next lane. Anyway, still sucks for him and hope they got a license plate number on the boat hauler.

Agreed. Dude dropped a hazard into the road, dude is responsible for it. However - being a cyclist myself, as soon as you see something like that in the road, you begin to brake as hard as is safe. You don't try to figure out what it's going to do, you honor what it MIGHT do, and try to ensure that if you do hit it, you do so at the lowest possible speed.

I'm marking this as 85% blame on the fucktard boat guy who dropped his shit on the highway and 15% on the rookie motorcycle rider who put himself in a questionable situation and did little to make an escape.

Boat guy should be ticketed, pay for all damages, and pay a $10K punitive fee.

Motorcycle guy should be ticketed and be required to pass a comprehensive motorcycle training program before returning to the roads.
