That's either undercharging the attackers or inadequate reporting by the author. The three surviving attackers could be charged with murder under the "felony murder" provision in most jurisdictions. The reasoning is that death is a foreseeable consequense of attempting a felony involving a weapon. Being that he's a waiter, he probably had a bit more then $37 in cash on hand. I know some waitstaff who earn upwards of $250 a shift (and not the kind of waitstaff who work in adults-only places, just normal resturants.)
As for the ass-kicking, mad props to the marine. Those kids look like your typical gang-banging thug N-words. Hopefully, they get put away for about 10 years, less criminal trash on the streets.

not that uncommon for people that dont know what they are doing. Figuring that this was probably a used/stolen gun, handled by teenagers with no firearms knowledge, who didnt clean it, and probably used cheap/old rounds, it could have easily misfired. Depending on what type of 38 it was, a dozen things could have caused a misfire.Originally posted by: MIKEMIKE

Teenager Christopher Daniel seemed timid and scared as he shuffled, leg chains loudly clanking, into a packed Atlanta courtroom today. But police say the petite, 125-pound 19-year-old was part of a menacing five-member robbing crew that randomly pounced on victims, including former Marine Thomas Autry, attacked on Memorial Day while walking home from his job waiting tables at a Midtown restaurant.
Lawyers for Daniel and three other defendants ? Kendall Barksdale, 17; Keyunta "KK" Dowell, 16; Christopher Hayes, 18 ? today asked a judge to release their clients on bond as they await trial on charges of aggravated assault, possession of firearms in commission of a felony, and criminal attempt to commit armed robbery.
Autry, who quietly sat in court today watching his alleged attackers fight to get out of jail, has previously described how he was beaten in the chest with brass knuckles, with one of the culprits pointing a gun at him and pulling the trigger. Luckily, the gun jammed.
Autry fought back and stabbed Daniel and suspect Amy Elizabeth Martin, 17. Martin died within hours. Daniel, whose lung was punctured, remained hospitalized for weeks from stab wounds to his chest, shoulder, side and back, his attorney, Brian Steel said. Daniel was recently transferred to the Fulton County Jail, which is ill-equipped to provide adequate ongoing treatment, Steel argued today.
In court, Daniel teared up and dropped his head as his father testified that he would stay home from his job running a nursing agency to watch over his son if the judge grants bond.
"This is the most important thing to me," the soft-spoken father said.
Daniel's father and mother told the judge they would personally watch their son and would pay for him to wear an electronic monitoring device around his ankle.
About 50 people crowded into the courtroom to support the teens, several others wrote letters to the judge. Dozens more spilled out into the hall to lobby for bond for the three other defendants whose hearings will be later today.
