Benjamin Golden, the former Taco Bell executive who was fired after video of him drunkenly assaulting an Uber driver in California went viral, is now suing that driver for $5 million.
The suit which claims that cabbie Edward Caban's recording was illegal and that any injuries he might have sustained during the incident were his own fault was filed on Dec. 7, CNBC reported Friday.
Golden's lawyer, Courtney Pilchman, told the network that Caban appears to be "quite the opportunist," and that "there's very little truth to the damages that he claims.
Caban, 23, said he could barely sleep after the incident, and that hes been plagued by headaches, paranoia and anxiety attacks.
Days after the assault, the driver filed suit for more than $25,000 in damages for "assault, battery, intentional infliction of emotional distress, and negligent infliction of emotional distress," ABC 7 reported in November.
That total pales in comparison to what the 32-year-old Golden, who was arrested and charged with four misdemeanor counts of assault and battery following the violent incident, is now after. He also wants video of the beating, which has been viewed some two million times, barred as evidence in the criminal trial.
Golden claims to have "suffered severe emotional distress, humiliation, anxiety, fear, pain and suffering" along with his loss of job, according to the new suit, which was obtained by CNBC.
But not long after the video blew up, the ousted exec went on record and admitted not being able to remember the incident, breaking down and saying, "It's not me in the video. It's not me. It was hard to watch and I'm ashamed."
And Caban's lawyer, Rivers Morrell III, said Golden was made aware that the tape was rolling.
"It [the suit] just tells me how disingenuous Golden was on his apology tour," Morrell told CNBC. "What's he want to apologize for if everything was the fault of Edward?"
The viral footage showed Golden repeatedly smacking Caban in the head after the driver stopped to kick the passenger out of his car for being too drunk to give directions.
Golden is also planning to pursue legal action against everyone who disseminated the video, CNBC reported.
