Just got this....chair's on the truck..we'll see what happens.

I believe it will be the same case for me even if I have not received it yet. The online tracking information shows the shipment is only 1 lb.

I ordered the chair yesterday for store pickup.
I got the chair yesterday and assembled it.

I got the bolierplate "we made a mistake" email from office depot just now.

I called them up and explained that I have assembled the chair and
it is used. They said the chair being free was a mistake. I told them
that I have gotten lots of stuff for free (and more free after rebate).

They said they would escalate my case to find out what to do and
get back to me.

As far as I am concerned, if they want their chair back, they are free to
pick it up. I even have the box of packing material. Of course the chair
might get a bit of wear and tear...

If they try to charge my credit card more than $0.97 or so, I can
show their receipt for $0.97, and claim any other charge was not
authorized by me.

I got 2 UPS tracking numbers. My chair is 37 lb and nimh batteries 0.2 lb.
And UPS says its out for delivery. I shd be getting in another 2 hrs.

If it's in your hands and you have the 'receipt', I think it's yours. You'd just dispute it with your CC company and send them the receipt also.

They delivered the filler items already. It looks like the chair will never arrive. I only purchased the filler items in order to get the chair.

Now what do I do?

I got that email to but just received a call from the delivery person saying he was at my house but unfortunately I wasn?t there to sign for it. Hopefully I will be able to confiscate it before office depot pulls the order.

i got excited when i got my tracking number...but i only got the filler items. i have a bad feeling the chair is not coming. can i return these items in store? i don't want them

i only got one tracking number....and it was only for my filler items

Well...I'm not sure what I need to do if anything at this point. I received both chairs ( for me and the wife) plus my other items before I received the email. I'm not sure if I should call them or not. I definately don't want to have my card charged for 89.99 a pop!lol

Disclaimer: I am not a lawyer.

I have been thinking about what to do with my chair.
Based on my tiny legal knowledge, it seems there was a contract between me and OfficeDepot. I paid them money, and got consideration (something in return). Since I have paid, and they have delivered, it seems the contract is finished. I don't think they can legally change the terms of the contract by charging me more money *after* they have delivered the goods.

Just a thought.

I love how they are constantly changing my order details.
First, they just deliver my filler item. Then the chair changes to "3 day delivery" online. I have to call them up and they say they will deliver the chair on monday. Now, as of this morning, the chair has a "special order return policy".
I dont understand how they are just able to change things like this after the sale has been made.

Just dispute it with the CC company. I did mine in-store pickup and even though the manager saw the low price, he had them up front for me. They even helped walk them (2, one for me, one for my wife) out to the car.

I read your post. My order is the same. I got the filler item yesterday, it even lists the chair in the invoice. I still have not gotten an email saying my order was canceled and the website still says "shipped by third party" Is it safe to say i am not getting my chair?

All I know is I am NOT paying for the filler item, which in my case is a $15 chair mat, if I do not get the chair. Thats just B.S.

They can not charge me for my order and then only supply me with half of it.

crap...still no chair. i dont' even have a tracking number for the chair. the status of my order says delivered, and i only got the filler items.

can i return these in store? i don't want these

I decided to do a store pick up in Northern VA. When I went at 7 PM after work, the kid told me that Corporate told them to cancel all the chair orders ("invalid coupon")! Darn, I should have picked it up immidiately after they confirmed the order before they decide to cancel! Oh well, it was too good to be true any way. Good luck to the rest of you guys...
