Negligence, sure. Emotional distress - bullshit claim. False imprisonment???? Really? Lady, you were there on your own free will.

A woman from Ferndale, Mich. is suing United Airlines after she was left alone on a plane for hours after it had landed.

Ginger McGuire was aboard a United Express flight from Washington, DC to Philadelphia. She says she fell asleep during the flight. It landed shortly after midnight Tuesday but no one woke her up until a cleaning crew found her four hours later.

United Airlines says they are working with a regional partner carrier to determine why the plane wasn't cleared upon landing.

McGuire told reporters, "I fell asleep on the plane and next thing you know I wake up, it's 4:00 in the morning. Nobody's on the plane. Nothing."

McGuire has hired Geoffrey Fieger who is filing a lawsuit for false imprisonment, emotional distress and negligence.

That is weird...

I could see negligence, but the other claims are a bit of a push, unless she somehow couldn't leave when she woke up.

Knowing the current flight climate it wouldn't surprised me if she was detained by security when they found her until they figured out she was there accidentally. Just a guess.

But she's from Michigan, how else is she supposed to make a living?

there should be a rule that forbids you from claiming negligence and false imprisonment in the same suit. if one is true the other is, logically speaking,false.

BS but I hate the greedy airlines more than I hate dumb bitches.

greedy airline? most of them are struggling to stay afloat.

and it's wrong that they left her there (wouldn't be if it there was a connecting flight), but worth a lawsuit? hells no. the court should fine her for the waste of time.

I really don't understand these rush to the courthouse and file suit shenanigans - ok, I do, it's just a quick way to try and force a settlement while the story is still in the news. No state has less than a two year statute of limitations on negligence claims, so it's not like you need to sue three days after the event happened.

I really think there should be a moratorium of at least a couple months before suits can be filed.

It's pretty easy to connect the dots then, imo. I know if it was my wife, she would have probably had a panic attack, which would lead to a seizure.

edit: ...though she would have never been in that situation to begin with. Like CV asks, who sleeps through a landing?

i see no fault in the passenger. but plenty in what the airlines did.

i was flying out to DC every week. after 3 months of it i was sleeping on landings every now and then.

I agree. She actually has a solid case. If no attendant woke her, (and I'm pretty sure there is some policy in their manual that says they have to) then they screwed up. In the eyes of the law, I can see this being a good case.

What? Very large object traveling at a high speed impacting on 3 points to very solid ground would be felt by anyone. Hell, the momentum change when they pop the airbreaks and slats to slow the ground speed down can wake the dead ...
