I agree. She actually has a solid case. If no attendant woke her, (and I'm pretty sure there is some policy in their manual that says they have to) then they screwed up. In the eyes of the law, I can see this being a good case.

This opinion is based upon your years of experience as an attorney? Airline may very well have been negligent and may have falsely imprisoned her (all depending, of course, on the elements of both torts in the relevant state). Problem is going to be damages. Getting a couple extra hours of sleep is not exactly the type of stuff that makes for a big cash judgment.

In all likelihood, the airline will give her some token payment if she sues (my guess - something like $5000) just to avoid publicity and legal fees. I've seen too many cases like that - your client would in all likelihood win but it's just far cheaper to pay the plaintiff to go away.

greedy airline? most of them are struggling to stay afloat.

and it's wrong that they left her there (wouldn't be if it there was a connecting flight), but worth a lawsuit? hells no. the court should fine her for the waste of time.

Didn't you get the memo? Anyone trying to turn a profit (aka make a living) is greedy.

How the hell could all those people walk by her and no one kinda enough to wake her up.

-Just watched the video she could not leave the plane and the police and TSA would not let her off the plane.

Really? They have computer controlled landing now. You won't notice even when awake.

Apparently Delta, US Airways, Southwest, Jetblue, and Northwest all don't use that then...

When's the last time you were on a commercial flight?

The fact that this women didn't wake on landing, and no one bothered to try to wake her or to get her off the plane, shows extreme negligence on the part of the airline. What if she had been sick, dying, or dead? There is nothing frivolous about this lawsuit.

I don't know what to think about the lawsuit, but that had to be crazy waking up at 4am on the plane, it's not moving, and no one is on it. You're already groggy, that's got to be a total WTF?!?!?!?!?!?! moment.

Closest thing I had was when I was riding BART home when I lived in the SF Bay Area. I fell asleep and missed my transfer to the Fremont station, and woke up at the Dublin/Pleasanton station. Another time I fell asleep and missed getting off at Fremont, which was the end of the line. The train actually waited it's 20 minutes or whatever it does before switching directions, and took off again. I woke up going the opposite direction from home at the Bay Fair station. Took me a bit to figure out why the train had turned around.

flight attendant should have attempted to woken her up... and if that didn't work, security and possibly a medic should have been called in to rouse her awake..

i see no fault in the passenger. but plenty in what the airlines did.

i was flying out to DC every week. after 3 months of it i was sleeping on landings every now and then.

She feel asleep on the plane... why is that the airlines fault? Imagine you went to a local library (or barnes and noble) and feel asleep in one of the aisles. Is it the library's (or barnes and noble's) responsibility to find you and make sure you wake up by the time they close? Why shouldn't the airline counter-sue for trespassing?

she was ON the plane. they have a responbility to clear the plane before they leave.

they didn't then they locked her in and wouldn't let her out.

they can't sue for trespassing. they allowed her on the plane thats nto trespassing.

this lady actually has a good case. people think its stupid (yeah i do) but she has a case. is she going to win a lot? no. but she is going to get several thousand out of it

Her suffering is worth a complementary ticket to Cleveland and a glass of STFU.
This. The airline probably fucked up by not waking her. Apologize, give her a free plane ticket, and that's it. Lawsuit is bullshit.

It's extremely rare but I've been on a flight where the weather was perfect and apparently the pilot was very good. Didn't know we touched down until the breaks and reverse jets were being applied. Extremely smooth landing due to perfect conditions. But 90% of the flight landings suck.

It was a small plane, she was locked in it over night, so the false imprisonment may stand.

The really funny part is the dumbass checked her CELL PHONE for the time and did not think to call for help.

who is she going to call? the cops or the airline? they knew she was there and wouldnt let her off.
