i had it .... let's see, you pay like $5 a month, and there is a $50 deductible, plus $15 for shipping of a new phone... basically, you're just putting your own money in someone else's piggy bank hoping you'll collect it someday.

it's still op's fault losing his phone in the first place however....

what an interesting turn this story would take if that were the case.

in any case, i hope you can resolve this issue, but i hope you do realize it could've been dropped to the ground by a random customer before being discovered by the workers...

I thought about the whole swapping of SIM cards too. But why bother? Why not just take the new phone, swap the SIMs and dispose of the old phone and the OP's SIM card? Why even leave behind evidence of theft?

I didn't read the whole thread but just had this thought. If its a GSM phone, couldnt someone ahve swapped the card with a beat up razor and taken your mint for for themselves? Razors are very popular and if someone had the same service provider they could have done a quick swap....... always a possibility.

I know they didn't swap phones on me. All the pictures I had taken are still on the phone, and if they swapped SIMs then they would have gone with the phone. Speed dial is still there too, which is stored on the phone and not the SIM.

And I agree, I dont think someone would bother swapping SIM cards, its just not worth the risk of leaving the phone behind, especially since IMEI numbers are traceable as far as I know.

Most insurance is there to deal with catastrophic loss. The sort of thing that happens once or twice in a lifetime, and costs you many, many times your current bank balance. Since a new phone only costs a few hundred, which you are likely to have in the bank at any given time, it doesn't make sense to get phone insurance.

I know you are looking for sympathy but in the real world if you leave something somewhere and it is stolen no one is going to take the blame for you.

OMG, just about everyone here would be pissed it was their phone. But it's pointless to post something like this because everyone takes the "high road" and acts not only like they wouldn't be pissed, but also like it could never happen to them. They are all liars.

Of course I'd be pissed. I'd be angry at myself for losing the phone, and I'd be angry at whoever the douche was who broke the phone for no good reason. But I wouldn't be stupid enough to assume that the employees of the store must have been responsible for it, and I certainly wouldn't be idiotic enough to assume that they're liable in any way whatsoever.

Not the same thing. You dropped it while biking, this guy is certain he left it on the counter. In other words, you were directly responsible for the scratches whereas he thinks the employees may have done it. Huge difference. I'd be pissed too. I'm not saying he doesn't share the blame, but if things went down like he thinks they did then just about anyone would be pissed.

I don't understand where you're coming from. I have read plenty of cheap shots directed at the OP, but they generally focus on the fact that blaming Dunkin Donuts is the theme of the original post. The OP includes incorrect reasoning (re: the condition of the phone at the time of receiving the call) that has not been corrected -- on one hand, it's wrong; on the other, it justifies the anger at DD more.

Would I be upset if I misplaced my phone, resulting in it being damaged to the point of being barely usable? Yes, I would be furious if I had just spent $250 (V3i) plus several hours of my time hacking it, and I would be filled with rage if I believed that the damage was intentional. However, I think I would be barely calm enough to discuss (read: rant about) the events with my coworkers, who would likely point out the flaw in my reasoning.

Once I had calmed down, I would be grateful that my microSD card was fine and returned to me and/or that I hadn't had a chance to get a higher capacity one yet.

I'll agree with you there, but they didn't. The flaw in the OP's reasoning has been pointed out, the phone was not necessarily undamaged at the time that the call was received.

Hey, I work at that Dunkin' Donuts!

The truth is we played hockey with the cell phone in the back room. Usually we use stale donuts, but we couldn't resist giving the Wayne Gretzky treatment to that sexy hard shiny cell phone. Especially from Mr. You Damn Idiots I Need More My Sugar In My Coffee 'Cause The Donuts Ain't Sweet Enough.

We were thinking of battering up the phone and giving it a real Dunkin' Donuts deep fry, but we wouldn't be able to use the "gee, we didn't do nuthin' with your cell phone, mister" excuse.

Anyway, it wasn't until the next day that we realized that a surveilence camera caught our hockey hijinks for posterity. We made a copy of the tape and have been playing it back over and over and laughing our butts off each time we go in the back room for a break.

This is just too funny to keep to ourselves. I'm going to post the video on YouTube. He shoots! He scores!
