don't just take this kind of crap from online retailers!! fight back!

i'm not sure how other than legally (small claims court or class-action) but d@mmit, i've had enough of this cr@p from online retailers -- none of this would fly at all if it were local, they would be required to fulfill our pre-orders, and if they didn't then you could just sick your state's Attorney General on them and they would have to give it to you eventually.

why are we allowing ourselves to be taken advantage of by these online retailers?? fight back i say, fight back! (don't ask me how, anyone got some great ideas??)

Today I called Gateway and was told all Visiontek Ti4600 graphics cards would go out March 13th, and I was even upgraded to 2day shipping for free. Then just a short while ago I received the following Email:

"Dear ****** ********,

Thank you for placing your recent order with the Gateway Accessory Store. We regret that our supply of the XTASY GEFORCE4 TI4600 has been depleted, and we are unable to replenish our stock at this time. Consequently, this item has been removed from our inventory list and cancelled from your order #*********. This item is no longer available from the manufacturer and will not be listed on our site in the future.

We apologize for any inconvenience this may have caused and look forward to serving you again. Our site has a full compliment of products. Return to our site at http://www.necxdirect.com/?nonce=guest_gate to find a suitable substitute.

And thats it (few personal items removed). I'm a bit concerned with what the following quote means though
"This item is no longer available from the manufacturer and will not be listed on our site in the future."
Hopefully something bad hasn't happened leading to a recall of all Ti4600 Cards. Oh well I'll order a Gainward for $379 and have Dual DVI out, cooler looking card, and the special Firewire/3d glasses expansion card (not to mention golden sample )
Don't get me wrong I'm still severely pissed off :|:Q:|:frown:

I think this cancelling is only for items that Gateway has no hope stocking in future:

I received an email from them regarding my order on Asheron's Call, TWO days after I found out it was cancelled from the online order status check.
BTW, they also reduce my coupon from $50 to $45.55.
Funny thing is, I order AIW Radeon 7500 which was not in stock at the time when I placed the order, and NO ETA was given. Yet, it was shipped Mar 1. Again, they emailed me about that on Mar 4!

You know.. I hear a lot of people bitching about Dell, but I have nothing but praise for Dell. I've managed to get in on a few price mistakes on Dell's site and they've always honored it even though it probably cost them a good amount of money. Sure, you have to put up with long hold times and a few inept CSR's, but in the end, it always works out with Dell. At least it has for me.

Gateway OTOH has been a complete dissapointment. I got in on some pricing mistake a while ago with Gateway and they did the same thing that they are doing here. They just sent a email message saying that the order was cancelled and that I had the choice to re-order at the correct price if I wanted. I just think it's lousy of Gateway to pull something like this and it doesn't surprise me in the least that they are getting their arse whooped by Dell right now.

You know.. I'm talking about this like it was a price mistake and I just realized that it wasn't. Just because Gateway didn't like that you used their coupon to order this card, they don't want to ship it? Are they saying that they can no longer get a card from the manufacturer when the card is new? That's screwy. No coupon for future sales or anything? That's rotten. We should all tell them where they can stick the cow.

I wonder if Gateway pissed off Visiontek for selling these new cards at a considerable discount? I know in the high end audio world, that some manufacturers or importers will pull a dealership if they are caught selling the item quite a bit below what everyone else is? Hmmm.. I'd love to know the reason behind this.

I just got my canceled notice from Gateway. Arrrgh. :|

On the bright side, I have a friend who can get me a Geforce 4 4600 cheaper but I was looking to pay 4400 prices, not 4600.

As I said in the original thread - this is pure bad business on their part. They had no damned qualms about making me wait 2 1/2 months two summers ago for my Elsa Gladiac 920 GF3 - but the only reason they're doing this sh*t now is because they don't want to make good with the 50 of 199 coupon. I worried about this to begin with. Nearly 10,000 people were made privy to this - and god knows how many bit. I'm going to call them tomorrow and DEMAND my order be replaced on a backorder status for the PRICE I PAID for another 90 days - AS IT SAYS ON THEIR SITE. As I said before - I have TWO GF3s, a regular and a Ti200 - I'm in no real rush to get a Ti4400 at the moment.

I think the most we can hope for out of this is another 50 off 199 code, you know, "out of their generousity" - but it's a neverending spiral, because people are just gonna wait for it to come IN STOCK again and then we're just gonna have this happening recurringly into June.

What troubles me the most about this is that this was a legitimate business transaction - not a fluke like the supposed 179.99 Ti4600s at BB.

You do not mess with people like this. Specifically you do not F*** with GAMERS like this. Anyone with a bucketload of oily rags and a full tank of gas feel like driving to Massachusetts to their HQ?

I know this sucks, but it's all a game, buddy. Remember that we try to screw vendors with dubious PMs and coupons and digitally altered receipts. We win some, we lose some. Also, lets not make a judgment on Baitway until we see that it starts to sell the 4400s again. They could truly be out . . .

Lets just move on to our next Hot Deal victim.

Please stop refering to this fiasco as a PRICING MISTAKE.
None of the stuff we ordered from Gateway was a pricing mistake.

We took advantage of what was presented to us which is a $50 off coupon.
Hey, like I said, they knowingly put out this coupon for us to use.
What would be their reason for not honoring the coupon ?? NONE.

Just look at the stuff they took off their site.

GF4 4400 and 4600
1.6A Northwood
Toshiba m-81
And more that we don't know of.

All of the stuff I mentioned is still being supplied(or will be supplied in the future) by Ingram Micro.(for example Ingram Micro do have the 1.6A instock).
They just decided to cancel all orders because they were overwhelmed by the amount of COUPONS being used.
Thats the botom line !!!

Its not our fault. They put out the coupon for us to use.
If they don't want to honor any of these back-ordered stuff, at least give us back the coupon so we can use it for something else.

We can't to let Gateway get away with this.

When I had my old GF3 order (made May 11, 2001) (sorry - it was 60 days, not 90) - I was calling once every day, basically, to see when they were getting a new shipment in. I ordered the card on my BDay - May 10, 2000. I didn't get the card until July 5th. Gateway didn't care how long I had to wait THEN, and I had used a 40 off 199 coupon.

So this BS about cancelling orders due to inavailability is BS. They didn't mind keeping ME waiting.

And the "60 day" policy was made well-known to me in the GF3 order. It wouldn't surprise me if they deleted that line in their policies while they were taking the Ti4400 and 4600 off their database.

Gateway has lost my business for good. The only decent thing I ever got from them was the free after rebate HP 9900 DVD/CD-RW drive.

golfreak - Grow Up. You are not entitled to anything other than what you got. Unless Gateway specifically mailed you the coupon then what makes you think that you were entitled to use it in the first place? Gateway did not advertise the coupon anywhere on their website. The $50 coupon like most that float around deal sites are posted without the companies permission and unless you have a copy of the original coupon email and that email explicitly states the coupon is transferrable then you used it illegally. Any company, Gateway included, reserves the right to cancel orders that are placed under false pretenses with illegally obtain coupon codes. You win some and you loose some now get over it.:Q

I received my cancellation tonight also. I'm really ticked, in addition to e-mailing them, it'd also help others to rate them at Anandtech Ratings. I might expect this from a smaller online company but you would think that Gateway wouldn't be pulling these kinds of shenanigans.

GetReal, gimme a break. It was a legit coupon for anyone to use. Gateway just didn't want to take a loss on the card. It's ok, though, we will make them pay for it in lost customer service resources (calls and emails).

Whether they're in OEM systems or not is a moot point. If they're taking the cards WE ordered, tore open the packages, and are now using them in their top-of-the-line systems, then yes, that is VERY against the law.
