I'm not actually clear if you read my post. I never said there was a reason to believe her. I literally just said the evidence for disbelief is only as strong as the evidence for belief is and so I see no reason to take sides at all. All I was doing was commentating on the structure of the argument itself, not on either of the two sides.

I think Abraxas isn't wrong, from what we know so far either side's evidence could be easily faked. I don't think this alone would be enough to support a conviction in court or anything like that.

But I think the motive and circumstantial evidence at least support the customer far more than the server. The restaurant's newer response has also been more reserved and it doesn't look like they're fully behind the server anymore. They're conducting an "investigation" when they could have presented a credit card statement in retaliation (my guess is what they're really doing is trying to figure out how to best damage control including talking to attorneys since I'm sure they've already checked their records... their FB page is getting pummeled, this has to be really terrible for business) The server herself seems more or less unreachable now which makes the whole thing look more suspicious.

The NBC News out of New York just ran another story, they dug into her background a little more and it gets worse. She was dishonorably discharged from the marines for not showing up when required. At a previous job as a waitress she faked having brain cancer to win sympathy.

I've known someone who have lied about being raped and even impregnated by the rape as well. I know she lied because, like Morales, she later admitted to it. It's difficult to relate with but some people are really very desperate for others to care about them that they'll make up all kinds of things for sympathy. Morales' disputed claims, including the homophobic remark, all seem to fit this pattern. I wouldn't automatically assume she intended to collect money from this or even somehow hurt the customers, but who really knows...

What I am saying is that so far neither side had put forward particularly compelling evidence. I am saying there are groups that stand to benefit from either side lying, her financially and groups out to fight gay rights by smearing those who claim discrimination. What I am saying is none of the easy ways to verify who is being truthful have been used, or at the very least reported as confirmed by the OP or any other media outlet I was able to locate. Former friends and acquaintances of the New Jersey lesbian waitress who claimed she was stiffed on a tip because she was gay, say that evidence Dayna Morales made up the whole story isn’t surprising: she has a long history of fabricating similar, and even more elaborate, stories about herself.


"She lies about everything,” said Samantha Reidy, former lesbian partner of Morales

Former co-workers and friends have now come forward with accounts of the elaborate lies that they say Morales tells to get attention and sympathy.


Morales’ alleged stories include telling co-workers that she had shaved her head in preparation for her upcoming brain-cancer treatment, reported NBC 4 New York. Former co-worker Jacqie Fitzpatrick said that instead of getting any treatment, Morales leaned on the story to get co-workers at a Cheesecake Factory in Nyack, N.Y. to perform her responsibilities.


Morales allegedly told co-workers from a daycare that Superstorm Sandy had hurled a boat through her living room wall, reported The Journal News.



But when friends investigated, they found no such damage.


“Every story she comes up with has a lie,” said Julie Howat, a former acquaintance of Morales


Howat related how Morales loved to tell people her war story, where as a Marine she said she was sent to Afghanistan and survived an explosion that killed her entire platoon, leaving her the sole survivor.
But spokesman for the Marines, Major Shawn Haney, said in an email to

The Journal News that while Morales did serve in the Marine Reserve Corps, she was dishonorably discharged in May after not showing up for drills.

“There is no indication of combat service in Iraq or Afghanistan,” he wrote.

Another acquaintance told The Daily Caller News Foundation that Morales once related how her dad raped her and got her pregnant. When no child appeared, Morales allegedly said that cervical cancer had infected the baby and killed him.

Morales has denied fabricating the writing on the receipt, saying she does not know how it appeared.

The Gallop Asian Bistro, which at first defended Morales, is now running its own investigation.

Why would anyone expect she would ever go through with the donation? She is a proven liar who doesn't like the military (kicked out for not showing up). Being caught doesn't turn someone into a saint, she fell back on the thing that has worked best in her past - lie to get ahead.

Eh, she didn't take anyone's livelihoods, the people who donated to her did so from spare money they have. There are far larger scam artists out there who destroyed many, many lives taking their money.

I don't know, I put her on the same level as a street corner pan-handler who is not actually broke, homeless, or war vet.

Her punishment now is her name will forever be tied to these scam stories via instant google search for the rest of her life. She will never escape this incident, and I suspect will have a very, very difficult time ever getting hired again.
