I thought the ATI Radeo 9800 beat down this card when it came to the benchmarks? Therefore wouldn't it be better to put your $400 into the ATI card? I'm just remember the details from an issue of Maximum PC where they compared the two.

Beat down isn't exactly the word for it. It's actually the other way around if you read the review on this site, the FX 5900 Ultra tops the 9800 in all the tests, except Comanche.

And yes I realize that other benchmarks exist but I'm certain nVidia is cheating on many of those too.
