Actually, I think according to CA law, because fault was assigned only to one side (assuming in this case the fat woman), she can legally sue and get money. Something similar happened to a friend of mine who's car got totaled (not her fault at all), but she was scared that if 100% fault was put on the other driver, she would get sued.

This sounds counterintuitive

several years ago my mom was leaving at 6am to go to work driving down some residential streets a few blocks from our home when a lady decided to back out of her driveway without looking and backed into my mom as she was driving by. Luckily my mom was not hurt and her car wasn't in mad shape but the lady sued i dunno how much later saying that her and her husband were trying to get pregnant when the accident happened which she blamed on my mom, and because of her neck injuries she was unable to have sex for months and so she never got pregnant.
the case was given to my mom and the lady was ordered to pay for the car damges haha

you dont have to be innocent or even right to be able to sue. Your girlfriend should countersue for even more.

When a lawyer is hired in a insurance case they are representing the insurance company, NOT the person. The lawyers job is to keep the claim as low as possiable. BUT if the claim goes well above the amount the insurance company has to pay, they will cut their loses and leave you out to dry.

If you are ever in a position like that where the claim may/will be more then what the insurnace company has to pay, get your own lawyer. As theirs can make things worse.

I can sympathize with the fat lady though. I mean, those grocery bills are probably pretty expensive and she may really need the money to feed her and the rest of the Huts.

I just can't believe this is law.

anyone can sue anyone of anything they want. But this is just silly. if a person is 100% found at fault for something does not give that person special rights.

Similar thing happened to my sister. Car went left of center and hit a van in front of her headon. There was no place for my sister to to avoid the rolling van, so it rolled right over her car. The people in the van sued my sister then.

Pretty much in these cases, only the lawyers make any money. They know they don't have a winnable case, but they'll still collect a fee.

Maybe your girl isn't telling the truth? Maybe she ran the red light when the fat lady had advanced green? Maybe they both ran a red light trying to beat the light?

What was the final outcome of that, and on what grounds could they possibly sue? Or rather what where they claiming in the suit?

My insurance company did for me when something similar to this happened to me. The lady got 0.

I can't believe the fatass is acting like a victim here. I'm sure it's not her fault she's a tub of lard either. $400,000 would buy like, 800,000 donuts, yum!

Your GF should certainly get a good lawyer and countersue for pain and suffering

Hmm. It's not that farfetched. Think of people who have been acquitted of murder, yet still get reamed with civil penalties for wrongful death. I don't understand why the 100% fault would play into it though.


The reason people get reamed for civil suits but aquitted for murder is because the burden of proof is less for a civil suit so it is easier to be found guilty. On the other hand, there has to be evidence of guilt. If the person sueing has been shown to be at fault, then have no case. It doesn't matter how many lawyers this fat lady has, if the OP is telling the truth this case will get laughed out of court, as long as the GF doesn't get stupid and settle.
