Why would he even waste his time suing the girl. She's probably broke like most Americans.
You go after the big fish.
In the right state, you can win the lawsuit and garnish her (future) wages for life. Losing 1/2-2/3rd of all her paychecks is the second best punishment for her crime - the best would have been losing her life in the crash.
Speeding up to 90 to avoid an accident? Do tell... how often? What were the circumstances? What kind of car? You'd need a pretty powerful car to go from 80-90mph quickly enough where it would be useful.
If I drop down two gears in my truck and punch it from a 75 roll, it'll hit 90 in a second, then the redline shortly after.
I actually had to do this as a semi I was passing swerved left to avoid a car in the right lane that slammed on it's brakes for no reason. I'm not sure if he would actually have hit me had I not sped up, but I wasn't going to take the chance.
