Microsoft put a message saying "Do not lend or make copies of this disc."
I guess it's illegal to loan it then.
The "Don't Copy That Floppy" video similarly conflates the copyright holders' wishes with the law when they say that you are allowed one "and only one" backup. No such law existed. They were pretty much quoting Microsoft's EULA and others where that "licensed but not sold" BS was becoming industry-standard. Microsoft will never allow it to get tested in court but they can't just say "licensed; not sold" to strip you of your First Sale Doctrine and Fair Use rights. Atari tried that with the Atari Jaguar and failed miserably.
