Got a little Moral dilemma here(actually more of an ethical question). vendor sent me something i didn't order.

egghead (yes egghead) back in the day sent me an extra cd-rw. I called them up to tell them- they gave me a $50 credit towards my next purchase for having somebody from UPS pick it up.

Anyways, it is only the right thing to do. I can't believe you're even considering keeping it!

That's not a moral deliemna. The right thing to do is patently clear to everybody. It's a conscience dilemna though: Can you live with yourself if you keep this stuff? That's the real question - how important is your conscience to you?

Heh. I ordered a number of knives from an eBay vendor several times. He kept sending me extras. I didn't know why - I just kept them. Eventually, I got around to asking (I hadn't opened any of them) and he's like "Oh, you're one of my best customers. I sent you an email about each one of them, didn't you get them?"

No, of course I didn't - my eBay account points to an email account with about 50% uptime (That's a bad thing that I really should fix)

Hmm... now thinking about it, it may be a very riske marketing ploy. They send it to you, give you a couple of days, and if you don't call back, they'll call you and tell you its a mistake. By then you've probably grown to like the product and would eventually buy one. Sounds farfetched, but pwn3d.

some company used to do that with vacuums IIRC

That was a good thing to do. It would have taken a long time for your vendor to recoup that loss. I'm sure they appreciate it.

I know it's the law. Just because the law allows it doesn't make it the right thing to do. While it was tempting to keep it I simply could not do such a thing. What kind of example would that be for me to set for my two sons?

Depends on if you have a problem with it morally. If you do, send it back. If you don't, keep it. But remember, SOMEBODY is paying for that. If it's a small vendor, that could but a half a week's wage. People make mistakes all the time, i'd hope if i ever did something wrong, somebody wouldn't screw me over just because if their greed.

If i was in your situation, i would hope i had the morals to send it back. I have had this happen with smaller stuff (a bunch of books that was sent to me accidentally), and yes, i did notify the company.

Of course, you should return it. It's an expensive item, and it should be shipped well and insured at their expense. Call them before you ship it, tell them what has happened, and ask them how they want to handle it. Any half decent vendor should offer you something nice as a thank you for your honesty.

Your ignorance makes you a danger to yourself. Obviously, it's not illegal that NesuD has the guitar. He was not responsible for that, but the company will probably be able to trace something that expensive, and unless NesuD wants to buy it, he is in possession of someone else's property, even though he received it by mistake. The company is responsible for the expense of correcting the mistake, but NesuD the law will not allow to benefit unfairly from it.

Besides, a guitar with that history would be a drag to own or play.

Happened to me also when I ordered some sunglasses. I called the company and told me they would e-mail me a UPS shipping label for the product so I could return it and give me 15% off future orders. Guess what? They never sent the shipping label. Hey, atleast I tried

But, interestingly enough, our evening news featured a syndicated attorney who was talking about exactly this situation. He laid to rest a misconception: You cannot legally keep it without paying for it. He says that if an oder has been placed and accidentally filled as yours was, the company from which you ordered can demand that you return it, at their expense. If you refuse to do so, they can bill you legally. You cannot simply treat it as a gift. But, if I understood correctly (I was only half listening, so don't take this part as gospel), an unsolicited item is sent to you (you did not order anything), you do not legally have to return the item, etc. This is probably correct because otherwise firms would be shipping out tons of unsolicited stuff counting on us eventually paying for it.

I got something shipped to me that I didnt order once. I can't remember what it was, it was from a big company, Dell or HP, I called em and told em that they can send someone to pick it up, well, the guy got mad at me for not shipping it on my dime, so I was like "well F-U then" and hung up. I still can't remember what the hell it was, it was a few years ago.

I think that most people who say keep it are thinking of this from the wrong viewpoint... they are probably thinking that the seller is clearly and idiot and they don't deserve their stuff back, but what about the guy who gets shafted because he's expecting a guitar that he spent his hard earned money on... only to find that some jerk off got it and he's never going to see a dime of his money again.

I wouldn't want to be the guy who gets screwed, and I surely couldn't even look at the guitar without feeling like an ass. If I couldn't even look at it, then what's the point in having it anyway?

I've never been in exactly this situation, but I have been given more change than I deserved at a store. It's always nice to think about keeping it, but I would never do anything but return it.
