Got a Ticket for "Speeding" at 12:30AM, How Do I Contest?

I just got a ticket today on my way home for going 60MPH on a 40MPH zone. It's the first time I get a ticket, though.

The road I was at didn't have much lightning so it would've been pretty much impossible to see the posted speed limit, which I'll have to check if there was one even posted. Some other things are that the cop didn't have any lights on at all, so obviously I did not see him. He only turned his lights on when he was behind me, and afterwards he also turned on those blinking lights they have on top of the cruiser. And, obviously, it's fucking 12:30AM and there's no traffic at all so it's not like what I was doing was unsafe. The ticket was for $150, and obviously I don't want to pay that. What should I do?

There's quite a few roads where I live that are 40 but you would think they were 55 if you didn't know any better.

Don't get me wrong I completely agree that he needs to stfu and pay the ticket as it's well deserved. Lighting? That's about one of the dumbest excuses I've ever heard for speeding.

I don't know the road or the area you traveled in. If there were a lot of houses and you could tell it was a residential area you're probably just gonna have to suck it up and pay it. If it's a country road were there is house about ever 1/4 mile or so you might be able to talk it down easier, but don't use that dumb ass excuse. Simply say you missed the sign and thought it was 55.

if it's your first offense just plead guilty. you'll probably get pbj and maybe a reduced fine. there will be court fees though. if you get pbj you also will probably get 0 points. if you want to make sure you get 0 points lawyer up. the fine will hurt now but points will hurt much more over time.

also of course he had his lights off. that's part of the trap.

Wow the self-righteous anti-speeding brigade is out in force. It's asinine to say posted speed limits are anywhere close to the appropriate speed for a given road. That being said, when you do speed you do risk getting a fine, so don't speed if you can't afford to.

OP, contest the ticket, if the cop doesn't show up you win.

If he does, you probably lose. That's just how it goes.

Given that I don't speed and thus have a clean record, I think I'm allowed to be a little self-righteous in this case

I agree that some roads the speed limits are ridiculously low (i.e. the 35mph zone on a straight road with cornfields and a couple farm houses). At the same time, others are just fine. Point is, we don't know what kind of road this is, and regardless, speeding is speeding, so...

OP, not sure how this isn't your fault. If you couldn't see the reflective road signs, then you sure as hell would not have been able to see any pedestrians walking along. The fact that you couldn't see the police car is, if anything, even more hinting at the idea that you shouldn't have been speeding.


Pedestrians walking along at 12:30 AM... LOL, k. And I just checked and in the area there weren't posted speed limits. About 1/2 a mile from where I was stopped there was one for 50MPH and 1/4 mile up from where I was stopped there was the posted 40MPH limit.

In any case, all the people I asked said that have gotten tickets here have gone to court to get a hearing on it and the cops don't bother to go and so you get the ticket eliminated, so I'll just do that.

In any case, the point is that it's stupid. Exactly what danger is there in going 60MPH in a five lane road at 12:30AM, meaning there was nearly zero traffic (for the five minutes I was stopped three cars passed) and no pedestrians? Police depts. are money-grubbing pieces of shit. Instead of being attentive of criminals they're attentive of something that shouldn't even be an issue in the first place. And to prove my point on it simply being the department wanting to jack up their revenue, after I got on my way about two miles from where I was stopped he stopped another guy that had passed by me when we were stopped. I can only imagine he got several people for the same stupid shit.

On the ticket it says if you get any points on the license. It says 0, so I don't think so. In any case, I'll contest it because I asked four friends of mine and my godfather. One of them I know has accrued more than $1000 in tickets, and they all told me they'd gone to court, got a date for contesting the ticket, and that the cop never showed up and so the ticket got erased. So I'll do that.

Of course, what would be practical is simply that to avoid situations like these traffic laws are made that actually make sense. You can't compare and say that there's the same amount of risk in going over the speed limit at the middle of the day when the road is packed with cars and there's a lot of people in the sidewalks compared to the middle of the night when there's near zero traffic and obviously no pedestrians.

Ignorance of the law, is not a defense. Cops do not have to have lights on. You were speeding, by 20mph. Take your lumps and move on, you were fully in the wrong.
There WAS a time,(back in my day), when cops COULD NOT park on the side of the road with all their lights off.
