Got a Ticket for "Speeding" at 12:30AM, How Do I Contest?

Cannot fight this ticket. Don't bother trying.

1) You did speed, greatly even. So you are at fault
2) Signs are reflective. If you have headlights that work you should read the signs. Ignorance is not an excuse of the law. If your headlights were not on/don't work, you should have been ticketed even more.
3) Time of day does not matter. Speeding is speeding, and night time is worse.
4) Cops do not have to announce their presence. And he wasn't on the road driving at the time, so he didn't need to have his head lights on.

Also 20 over, is getting close to go to jail overnight speeding, especially at night. (@25+ over Cop's discretion to arrest the driver) You should consider yourself lucky. And Don't be a fool next time.

Well that's false. I just got the gf ticket changed from a u-turn in construction zone (points, massive ticket etc..) to $50 fine and $33 court fees. She was looking at 300-400 easy + points before that.

You can always get tickets reduced and in some cases removed. Saying otherwise is a joke.

No, I won't, because the probabillity that the cop won't show up to court is pretty high. As of now none of the people I've asked have said that the cop they got pulled over by had gone to court. And in case he does go to court, I'll use the fact that it was my first "offense" and the circumstances to get it lowered. And one of those circumstances is that the 40MPH limit sign was posted 1/4 mile ahead from where I was stopped and the other speed limit sign was for 50MPH, back two miles from where I was stopped. I'd just gone to the area earlier today since it's pretty close.

I didn't see any posted limits because there were none in the area.

Adults take responsibility for their actions. If you do decide to fight the ticket, go in with humility and not a sense of entitlement. Judges have dealt with thousands of people with bad attitudes. Surprise him with a good attitude.

Or you can continue to be a dick and see how that ends up for you. Hint: it won't end well.

1) You may get it reduced down, but for "first offenses" defense works better on insurance company rates than the law. So saying that as your only defense will do you little to no good at all. Otherwise EVERYONE would be able to use that, but it rarely ever works.

2) Also 2 miles apart between signs is more than enough. So you cannot use that as your defense. You passed one only 2 miles ago. As long as there wasn't a drastic change of scenery, which could warrant a new sign (Say country --> city, or vice versa) than the speed limit is still in play. Again ignorance of the law does not excuse one of the law.

Not an act of god. However a law imposed upon on the nation you reside in. Thus it is as good as if the physical manifestation of god that is the government said this.

How was I supposed to know the limit was 40MPH when the last sign I passed said 50MPH...?

If signs were posted noticing them is your responsibility. You need to demonstrate to the court the sign was obstructed.

You have not read the thread. Like I said earlier, I went through that road today and took notice of the posted speed limits. Around two miles behind where I was stopped there was one for 50MPH and 1/4 mile ahead where I was stopped was the 40MPH limit sign.

The last sign you passed did not say 50mph, otherwise it would have been speeding 60mph in a 50mph.

The last sign you passed is the limit, until a new sign says otherwise. If a road is unmarked, depending where the road is, an X limit is imposed. In a small urban area 35mph. Country can be 45 depending on stat laws.

Read your state driving rule book.

And Remember, if you go to court and are found guilty, you will have COURT fees added onto the $150, + gas and other utilities to get to and from the courthouse.

And regardless. If you go into court and tell the Judge you sped 60 in a 50 and not a 60 in a 40. YOU STILL SPED. And will be fined regardless. Once it gets into court even 1 above the limit you can be fined for.

Doubt it. The people that do contest it here are most of the time met with the excellent news that the officer did not show up. If the rare event does happen that he shows up, I'll have to use the circumstances to get it lowered.

I don't even have to read this thread to know ATOT posters are ruthless when it comes to this situations. Most of the members here act like they have perfect morals and ethics, it is so laughable because the real world is just the opposite with everyone bending rules to get ahead any chance they get.
