So today, some lady smashed her brakes when the light was just yellow. I thought there was plenty of time to go ahead but apparently she didn't so she just smashed her brakes. Anyway, so I hit her car and caused a little paint to come off. My car is slightly dented in the front.

She said she didn't want to call the police but got my name and number. I am lost as to what to do now.

Wow that sucks. Hopefully she really meant that and does not bother to call the cops. If she does you're probably going to be the one responsible for "following too close".

Though braking like she did is not very safe either, so may be disputable. You are suppose to stop at a yellow light provided it's safe which it was not in her case.

I know but in hurry I didn't. She said it was no big deal but would call me for details.

Disputable? Fuck that. She hit the brakes for a yellow light and he hit her from behind. That means he was driving too fast or close behind her. Hence, him at fault.

You should follow at a distance such that if someone smashes their brakes in front of you that you are effectively able to stop the forward motion of your vehicle.

And I agree that you should have a police report filed out or you could end up paying for the persons "doctor bills".

He would have been responsible anyway unfortunately....

She said it was all good and said she was ok. She seemed reasonable and was not upset. But that doesn't mean I made the right choice of not calling the police. I guess I'll wait and find out my fate. Thanks.

I think you'll be fine. I don't think she'll be able to prove that you hit her. The other thing is that you definitely would be in the wrong regardless if you were at fault or not so its a good thing the cops weren't called.

you always call the police.

And how would the police help him, the person at fault? You think the cop is going to give her a physical exam and pull his mobil x-ray machine out of his trunk???

Theres a good chance the operator would have juts said exchange info and get the F off the street and stop blocking traffic.

She probably didn't have insurance or a DL. Just wait and see what happens.

I was in a similar situation but I was the lead car and it was raining that night. I stopped because there was a cop there and I didn't want to risk running a yellow and being called on it. The car behind me messed their hood up nicely against my rear spare tire. If they hadn't hit me, they might have gotten a ticket instead.

The idiot passenger kept saying to the cop who witnessed it how I was "confused" whether I should go thru the light. The cop said with a smile... "he probably saw me and stopped". Genius.

Luckily she prevented you from getting a citation.

Unfortunately you now have no legal documentation of what happened in the event she sues you.

Assuming it was, in fact, a very, very minor deal, then a deductible would be about the same as what it will cost to repaint/buff her bumper, and you can just deal with a car scar unless you have a really nice car.

Not disputable. OP is at fault.

I may be wrong but if the cops are involved then that means insurance too. So your 300 bucks of damage is going to cost you 4000 bucks instead. (your insurance will go up for like 5 years). Car insurance is one of the biggest scams ever.

Do not call them either, just get the damage fixed asap and forget about it.

fixed.

There ain't too many attorneys that'll touch a property damage case that doesn't have a chance to recover from a personal injury. Without a police report she has an uphill battle in proving liability let alone degree of any liability and subsequent injuries. I think at the most the lady will get a few estimates and send you a copy and ask for money.

You mean the drunk lady that backed into you and didn't want the cops involved?

I wouldn't worry about her.
