Got my 4th DUI last night

i also don't agree that you should be able to 'sleep it off' in the car. You don't think straight when drunk, and even if you do sleep for a while, you're probably gonna wake up drunk and probably are gonna drive drunk. Just because you feel better and think you're ok doesn't mean you are.

yeah great idea, guilty before innocent is awesome!

To the OP: What do you do (not in this case obviously) if the guy was legal and just went to his car in the parking lot to sleep it off?

I did it once. I wasn't drunk (as in 0.08 or over I'm pretty sure). I had a beer and a half over 2.5 hours or so. While I could've made it back, I was really tired (don't stay up to 2am doing grad school apps on a work night), so I knocked out in my car for 45 minutes. Felt fine when I woke up. But anyway, what do you do to a guy who's gonna sleep it off? I find it ridiculous to screw them over. I've heard of a woman turning on the ignition to charge their cell phone.

At what point do you consider a DUI? When the car moves? Getting in a car (even if it's for sleeping?) Turning on the ignition? Etc?

The point in which is becomes a DUI is the point in which the law considers you in full control of the motor vehicle. In Illinois, it's basically when you are inside the passenger compartment with the keys in arms reach or easily accessible. That being said, some discretion must be used in the case you describe above. I would have no problem with a person sleeping off the effects of a heavy night of drinking in the parking lot of the bar they were at. However, if they are in a different parking lot, one must weight the options. How did they get there? How far away is the bar they were drinking at? Are there any nearby motels or hotels they could stay in? Also, how cooperative is the person sleeping in said car?

Pretty much what FallenHero said. Also, if you slept for 45 minutes and were fine, you were most likely still over when you left, or you weren't really that high to begin with. I can almost guarantee that you wouldn't be anywhere near 0.08 after 1.5 beers. Good call on not driving anyway, though.

FWIW, the average person metabolizes alcohol at about 0.015/hr, so if someone is at a .20, chances are it's going to be over 12 hours before they're back to 0.00.
